RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration Committee
recommend to Council the following:
1. THAT Report PSD-001-03 be received;
2. THAT the application for draft plan approval and amendment to Zoning By-law 84-63,
submitted by Sernas Associates on behalf of Veltri and Son Limited be referred back to
staff for further processing and the preparation of a subsequent report following the
receipt of the outstanding agency comments and the completion of an Environmental
Impact Study; and
3. THAT all interested parties listed in this report and any delegations be advised of
Council's decision.

2.0 BACKGROUND
2.1 On November 29, 2002, the Planning Services Department received the last of
the revision documents required to circulate the revised proposed plan of
subdivision and related zoning by-law amendment application. The subdivision
application proposes to create 39 lots for single family detached dwellings, a
stormwater management block, a block reserved by the owner and local roads.
2.2 The area subject to the proposal is located in southeastern Newtonville, on the
proposed easterly extension of Jones Avenue and south of Payne Crescent. The
more formal location description is Part Lot 7, Concession 1, former Township of
Clarke.
3.0 LAND CHARACTERISTICS AND SURROUNDING USES
3.1 The site is currently vacant. The majority of the site is within the Lake Iroquois
Beach/Shoreline. A little over half the site (Block 41) is proposed to be reserved
by the owner as a nitrate dilution area for the 39 dwellings. The southeast corner
of the property contains a significant valleyland within which a tableland woodlot
covers most of the nitrate dilution area. The 39 proposed dwellings are proposed
on the northerly portion of the site.
3.2 The surrounding land uses are as follows:

4.0 PUBLIC NOTICE AND SUBMISSIONS
4.1 Public notice was given by mail to each landowner within 120 metres of the
subject property. Public notice signs were installed at the east end of the open
portion of Jones Avenue and on the south side of Payne's Crescent adjacent to
the unopened road allowance between Lots 6 and 7, Concession 1, former
Township of Clarke. A coloured subdivision plan was on each sign.
4.2 As a result of the public notification process, to date, the Planning Services
Department has received two inquiries concerning:
. access to the subdivision;
. additional traffic affecting the Newtonville Public School;
. the impact of additional septic systems on the groundwater;
. the future of the reserve block; and
. what additional studies would be required.
5.0 OFFICIAL PLAN CONFORMITY
5.1 The Durham Regional Official Plan designates the property Hamlet. In Policy
13.3.5, new municipal water service to a Hamlet is intended for only the hamlet
area delineated in the Area Municipal Official Plan. Municipal water service was
extended to Newtonville in 1989. The application subject to complying with the
relevant portions of Policy 13.3.9 would comply with the Regional Plan. Regional
staff will be providing comments on these matters.
5.2 Within the Clarington Official Plan, the southern portion of the property is
designated Environmental Protection, with the remainder being in the Hamlet
designation. A significant valleyland runs along the southern edge of the
property and a tableland woodlot is located on the north side of the valleylands.

Policies within the Plan stipulate an Environmental Impact Study is to be
undertaken for any development applications located adjacent to or within any
natural features identified on the Official Plan Natural Features and Land
Characteristics Map. An Environmental Impact Study is required.
6.0 ZONING BY.LAW COMPLIANCE
6.1 Within Comprehensive Zoning By-law 84-63 of the former Town of Newcastle,
the subject property is zoned in part "Residential Hamlet (RH)", in part
"Agricultural (A)" and in part "Environmental Protection (EP)". The proposed plan
of subdivision does not conform, hence, the rezoning application.
7.0 AGENCY COMMENTS
7.1 The rezoning application was circulated to various agencies and other
departments by the Planning Services Department. The Building Division and
the Regional Police Service had no concerns.
7.2 The Separate School Board requested that adequate provision for sidewalks be
made in the subdivision.
7.3 The Clarington Emergency and Fire Services Department noted that the
maximum length of a dead end street without a turn-around is 90 metres.
7.4 The Ministry of Transportation-Ontario (MTO) in providing preliminary comments
noted Ministry Permits are required for all signs visible to the highway. A
condition of draft approval was requested stating that prior to final approval, the
owner was to submit to the Ministry for approval, a copy of a
drainage/stormwater management plan/report showing intended treatment of the
calculated runoff.

8.0 STAFF COMMENTS
8.1 This proposed subdivision is abutted on the west by draft approved plan of
subdivision 18T-87083. This plan was approved in 1992 and it has 28 single
detached units and a park that is bordered by the school, Newtonville Road,
Jones Avenue, and Street "A". This park, when built, will provide recreational
opportunities for the residents of both subdivisions.
8.2 As the purpose of this report is to give the status of the application for the public
meeting, it is appropriate to have the applications referred back to staff for further
processing.
