SUBJECT: DRAFT PLAN OF SUBDIVISION - REMLARK HOLDINGS LIMITED
PART LOT 35, CONCESSION 2, DARLINGTON
PROPOSED REVISIONS
RECOMMENDATIONS:
It is respectfully recommended to Council the following:
1 . THAT Report PD-80-86 be received; and
2. THAT the proposed revisions requested by D.G. Biddle and Associates, by
letters of February 18, 1986 and March 13, 1986, as illustrated on the draft
plan of subdivision prepared by Donevan and Fleischmann Company Limited, as
revised March 13, 1986, be approved; and
3. THAT draft plan Condition No. 9 pertaining to parkland dedication be amended
to include a note that, alternatively, the Municipality may accept cash-in-
lieu of all or any portion of the conveyance; and
4. THAT all requisite changes to block numbers as illustrated on the draft plan
of subdivision be approved; and
5. THAT the Ministry of Municipal Affairs and Housing and the Regional
Municipality of Durham be so advised.

BACKGROUND AND COMMENT:
At the General Purpose and Administration Committee meeting of March 17,
1986, Staff Report PD-71-86, in consideration of the proposed revisions
requested by D.G. Biddle and Associates, was received by Committee and
referred back to Staff for further clarification with respect to the
ownership of said lands and the conditions of draft approval pertaining to
parkland dedication.
Staff would note for the Council ' s consideration that D.G. Biddle &
Associates' request of February 18, 1986 dealt with the inclusion of the

cul-de-sac at the most northerly end of the subject lands. Further to the
above it was brought to Staff' s attention on March 14, 1986 by
correspondence received from D.G. Biddle and Associates that the owners of
the subdivision had obtained the property north and south of the proposed
northerly road allowance entering onto Townline Road. To that end, Staff
was requested to include same for Committee and Council ' s consideration of
the revisions to the draft plan. Staff would note for the Committee's
information that Remlark Holdings Limited have provided Staff with copies
of an Agreement of Purchase and Sale pertaining to the lands as requested
for inclusion within the draft plan of subdivision.
In consideration of the above lands the area of the draft plan of
subdivision being 13.95 hectares would require a parkland dedication
and/or payment of cash-in-lieu, pursuant to the provisions of the Planning
Act, of 0.69 hectares. The draft plan provides for a dedication of 0.60
hectares. Accordingly, Staff, as contained within the recommendations of
said report, would recommend a revision to draft Condition No. 9 whereby
the owner provides a cash-in-lieu payment for the differential in areas
being 0.09 hectares (0.22 acres) .
