RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration Committee
recommend to Council the following:
1 . THAT Report PD-73-86 be received and that the following recommendations be
considered separately.
* 2. THAT the proposed amendment to By-law 84-63, included herewith as Attachment No. 1,
be approved; and
* 3. THAT the proposed amendment to By-law 84-63, included herewith as Attachment No. 2,
be approved.
BACKGROUND AND COMMENTS:
On February 17, 1986 the General Purpose and Administration Committee considered Staff
Report PD-38-86 in respect of various proposed amendments to the Town of Newcastle's
Comprehensive Zoning By-law. These amendments were being proposed as a result of Staff
review of the continued relevance of Zoning By-law 84-63 and were intended to correct
various errors and omissions within the by-law as well as provide clarification of various
other sections of the by-law. The proposed revisions were advertised in the various

newspapers having local circulation within the Town of Newcastle on February
12, 1986 and, as of the date of writing, there have been no written
submissions received in respect of the proposed amendments .
In accordance with the direction of Committee, Staff have divided the draft
by-law amendment to create two separate amendments; one dealing with the
question of auction rooms and the other dealing with the balance of the
proposed amendments. Barring any public input at the Public Meeting section
of the agenda, relative to these proposed amendments, Staff recommend that
the draft by-laws be approved.

ATTACHMENT NO. 1
THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW 86-
being a By-law to amend By-law 84-63, as amended, of the Corporation of the
Town of Newcastle.
WHEREAS the Council of the Corporation of the Town of Newcastle deems it
advisable to amend By-law 84-63, as amended, of the Corporation of the Town of
Newcastle;
NOW THEREFORE BE IT RESOLVED that the Council of the Corporation of the Town of
Newcastle enacts as follows:
1) Section 2 "Definitions" is hereby amended by amending the definition of
"Auction Room" by the addition of the words "or lands" following the word
"structure" in the first line.
2) Section 3.14(a) is hereby further amended by adding to the Parking Space
Requirement Table, the words "auction room" following the words "assembly hall"
in the first line thereof.
3) Section 24.1(b) is hereby amended by adding thereto the following new
xiii):
"xiii) an auction room"
4) This By-law shall come into effect on the date of passing hereof subject
to the provisions of Section 34 of the Planning Act, 1983.

THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW 86-
being a By-law to amend By-law 84-63, as amended, of the Corporation of the
Town of Newcastle.
14HEREAS the Council of the Corporation of the Town of Newcastle deems it
advisable to amend By-law 84-63, as amended, of the Corporation of the Town of
Newcastle;
NOW THEREFORE BE IT RESOLVED that the Council of the Corporation of the Town of
Newcastle enacts as follows:
1) Section 3.5(e) hereby amended by adding thereto the word "existing"
following the word "any" in the third line, and the words "upon a lot" prior to
the word "which" in the fourth line.
2) Section 3.14(a) is hereby amended by adding the words "and each aisle
shall be a minimum of 6 metres in width for two-way traffic and 4.5 metres in
width for one way traffic" following the word "width" in the tenth line
thereof.
3) Section 3.14(d)iii) is hereby amended by deleting the words "or any lot
line" from the fifth line thereof.
4) Section 3.14(e) is hereby amended by deleting the words "building or
structure" in the ninth line, and replacing same with the word "unit".
5) Section 3.19(d) is hereby amended by adding the words "a hamlet or"
following the words "limits of" in the eighth line.
6) Section 6.4.14 is hereby amended by deleting Subsection (a) and
Subsection (b) in their entirety and changing the prefix of Subsection "(c)
to "(a)".
7) Section 12.2(d)iii) is hereby amended by adding the words "and duplex
dwelling" following the words "semi-detached dwelling" for each occurrence.
8) Section 16.1(b) is hereby amended by adding thereto a new Section xxvii)
as follows:
"xxvii) existing motor vehicle service stations and motor vehicle
fuel bars".

9) Section 16.3 is hereby amended by adding thereto the following new
Subsection "(e)":
"(e) Existing Motor Vehicle Service Stations and Motor Vehicle
Fuel Bars
The expansion or enlargement of existing motor vehicle service
stations and/or motor vehicle fuel bars shall be subject to the
provisions of Section 21.3, Subsections (h), (i), (j)"
10) Section 17.1(b) Non-Residential Uses is hereby deleted in its entirety
and replaced with the following new Subsection b.:
"b. Non-Residential Uses
i) business, professional or administration office;
ii) day nursery;
iii) dry cleaners distribution centre;
iv) eating establishment; take-out;
v) laundry; coin-operated;
vi) convenience store;
vii) medical or dental clinic;
viii) private club;
ix) retail commercial establishment;
x) service shop; personal"
11) Section 17.5.1 is hereby amended by changing to "(C2-1)" the zone
reference contained in the title thereof and by deleting Subsection i) in its
entirety and by deleting, from Subsection ii) the prefix "ii".
12) Section 18.4.2 is hereby amended by deleting the word "schedule" in the
last line thereof and replacing same with the word "section".
13) Section 19.4.3 is hereby deleted in its entirety and replaced with the
following new Section 19.4.3:
"19.4.3 SPECIAL PURPOSE COMMERCIAL EXCEPTION (C4-3) ZONE
Notwithstanding Section 19.1(b), those lands zoned C4-3 on
the schedules to this By-law may only be used for one or
more of the following uses:
a. a motor vehicle towing establishment including temporary
storage and/or repair of motor vehicles provided that
said vehicles are stored within a fenced enclosure and
further, provided that no vehicle is stored for more
than thirty (30) days;
b. a new and used automobile sales and service outlet;
c. a service shop, personal."
14) Section 26.3 is hereby amended by changing to a lower case "g" the
subsection prefix for Subsection (f) and inserting, following subsection (e),
the following new Subsection (f):
"(f) Where an Environmental Protection (EP) zone boundary is
indicated as approximately following the flood line of a
watercourse as designated on floodplain mapping prepared by a
Conservation Authority having jurisdiction within the Town of
Newcastle, then for the purposes of this by-law, the boundary
shall follow such flood line as may be adjusted from time to
time by the Conservation Authority having jurisdiction for
same".
15) Schedule 1 is hereby amended by changing to "General Agricultural (A)"
zone, the zone designation of the lands so identified on Schedules "X" and
"X-2" attached hereto.
16) Schedule 1 is hereby amended by directing the zone boundaries for the
(RE-2) zone, Part of Lot 11, Concession 3, geographic Township of Darlington,
as shown on Schedule "X-3" attached hereto.
17) Schedule 1 is hereby amended by changing to "M2-General Industrial" the
zone designation of the lands so identified on Schedule "X-4" attached hereto.
18) Schedule 2 is hereby amended by changing to "Residential Cluster (RC)"
zone, the zone designation of the lands so indicated on Schedule "X-5" attached
hereto.
19) Schedule 2 is hereby amended by correcting the "Residential Custer
(RC)", "Environmental Protection (EP)" and "Agricultural (A)" zone boundaries
for Part of Lot 9, Concession 4, geographic Township of Clarke, as shown on
Schedule "X-6" attached hereto.
20) Schedule 3 is hereby amended by correcting the zone boundaries for the
"Environmental Protection (EP)" zone for Part of Lots 9 and 10, Broken Front
Concession, geographic Township of Darlington, as shown on Schedule "X-7"
attached hereto.
21) Schedule 5 is hereby amended by changing to "Urban Residential Type One
(R1)" zone, the zone designation of the lands so identified on Schedule "X-8"
attached hereto and by changing to "General Commercial (Cl)" zone and "Special
Purpose Commercial Exception Two (C4-2)" zone, the zone designation of the
lands so identified on Schedule "X-8" attached hereto.
22) Schedule 7 is hereby amended by changing to "Agricultural (A)", the zone
designation of the lands so identified on Schedule "X-9" attached hereto.
23) Schedule 9 is hereby amended by changing to "General Agriculutral (A)",
the zone designation of the lands so identified on Schedule "X-10" attached
hereto.

24) Schedule 13 is hereby amended by changing to "General Commercial
Exception Two (C1-2)", the zone designation of the lands so identified on
Schedule "X-11" attached hereto.
25) Schedule 14 is hereby amended by changing to "Residential Hamlet (RH)"
zone, the zone designation of the lands so identified on Schedule "X-12"
attached hereto and by changing to "Agricultural (A)", the zone designation of
the lands so identified on Schedule "X-12" attached hereto.
26) This By-law shall come into effect on the date of passing hereof subject
to the provisions of Section 34 of the Planning Act, 1983.
