GABOURIE PART LOT 35, CONCESSION 3, DARLINGTON OUR FILE : DEV 85-46 RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD-68-86 be received; and 2. THAT the application submitted by My,. G. Gabour•ie, to rezone a parcel of land being Part of Lot 35, Concession 3, former• Township of Darlington to permit the * development of three (3) additional lots, be approved and the by-law attached hereto be for•war•ded to Counci 1 for, approval . i BACKGROUND AND COMMENT: 1 On December• 17, 1985, the Planning Department received an application for, rezoning, submitted by Mt,. G. Gabour•ie to rezone a parcel of land located in Part of Lot 35, * Concession 3, former, Township of Darlington (see attached) . The submission of the rezoning application is to permit the development of three (3) additional residential lots. Within the Region of Durham Official Plan the subject ro er•t �� J p p y is located within the "Major, Open Space designation. Staff would note, however,, that Regional Council has . . .2 0 (j) REPORT NO. : PD-68-86 Page 2 adopted Amendment No. 143 to the Durham Regional Official Plan which would designate the subject pr•oper•ty within a part of the Cour•ti ce Ur•ban Area Plan. Accordingly and within the context of Section 8 of the Durham Regional Plan and, in particular,, Section 8.1.3.1 , residential development as i nfi l l i ng p r•i or• to the availability of full municipal ser•v i ces , is per•mi tted. Staff would note for, the Committee' s information that pursuant to Council ' s resolution of July 26, 1982 and the r•equir•ements of the Planning Act, the appr•opr•iate signage acknowledging the application was installed on the subject lands. Staff would note that no objection to the proposal were received at the writing of this r•epor•t with respect to the amendment requested. In accordance with departmental pr•ocedur•es the application was circulated to obtain comments from other, departments and agencies as noted within Staff Report PD-16-86. The following would summarize the comments as received. j Town of Newcastle Building Department "No objections." II Town of Newcastle Fire Department "This Department has no objection to the above-headed application. Emergency fire protection would be from Station #4, which is within an acceptable travel distance. " �I Town of Newcastle Public Works Department "We have reviewed the above-noted application for• rezoning and find we have no objection to this proposal provided that: 1. the owner, p r•epares a lot gr-ading and dr•ai page plan for, the subject lots. 2. the owner, provides at his expense the cost of any ditching on Lawson Road that may be necessitated as a result of the grading and drainage plan. . . .3 i REPORT NO. : PD-68-86 Page 3 Town of Newcastle Public Works Department (Cont'd) 3. the owner, contributes to the reconstruction of Lawson Road at the rate $30.00 per- foot (50% of the total cost) for, the frontage width of 294.50 feet. 4. the owner• provides street illumination for, the proposed lots to the satisfaction of the Director, of Public Works . 5. all works constructed ar•e in accordance with the Town's Design Criteria and Standard Drawings. " Ministry of Natural Resources "Ministry Staff have reviewed the above-noted rezoning application. We have no objections to the approval of this proposal , as it has no adverse effects on the pr•ogr•ams or, policies of this Mi ni str•y." Central Lake Ontario Conservation Authority "The above site is subject to Ontar•i o Regulation 161/80. Author•i ty staff requests that the owner• be i nfor•med that a permit from this Author•i ty is requi r•ed pr•i or• to any filling or• grading on all of the proposed lots . The Authority has no objection to the approval of the application." Peter•borough-Victoria-Not•thumber•land and Newcast e Roman Catholic Separate Sc oo Board "No objections." Durham Regional Health Unit "The above application for, rezoning has been investigated by this Health Department, and insofar• as health matters are concerned, there ar•e no objections to its approval . I would, however,, st►•ess that this letter• is not to be taken as a permit to install a private sewage disposal system at the site involved. The r•equir•ed permit will be issued only after, a proper, inspection of the land area involved has been made and said inspection will be car•r•i ed out upon r•ecei pt of a formal application." . . .4 REPORT NO. : PD-68-86 Page 4 Durham Regional Planning Department "In response to your• cor•r•espondence dated Januar•,y 9, 1986, we note that although the proposal may be permitted within the "Major• Open Space" designation in the Durham Regional Official Plan, Regional Council has adopted Amendment No. 143 to the Durham Regional Official Plan to designate the subject pr•oper•ty as part of the Cour•tice Urban Area. Accordingly, the proposed zoning amendment should now be considered within the context of Section 8 of the Durham Regional Official Plan and in particular-, Section 8.1.3.1 which allows residential development as infilling prior, to the availability of full municipal services. We note also that municipal water• supply is available to the subject pr•oper•ty from an existing water,main on Townline Road. However•, the Region has no plans to construct a water•main on Lawson Road or, to extend sanitary sewer• service into this particular area. In the event that you ar•e recommending approval of the subject application, we request that the applicant be r•equi r•ed to make sati sfactor•y ar•r•angements with the Region with respect to the provision of future services, including the payment of levies. With respect to the abutting Regional Road, we will r•equir•e a 17 ' road widening, a 50' x 20' sight tr•i angl a and a 1 ' r•eser•ve on the Townline Road frontage of the subject pr•oper•ty as marked on the attached plan." STAFF COMMENTS As noted within the comments submitted for, Staff's review, no major• objection to the principle of development were received but rather, comments which Staff would submit to the Land Division Committee for, their, consideration at such time that the applicant submits the appr•opr•iate Land Division applications. Staff would note, however,, that the above is pending Council ' s consideration of the rezoning application. Fur•ther•more, Staff would note that the comments of the Region of Durham Planning Department with respect to the servicing aspects of the subject lands and the r•equi r•ements for• road wi deni ngs and sight tr•i angl es and a 1' reserve on Townline Road would be concern that Regional Staff may address to the Land Division Committee for, their, consideration. . . .5 REPORT NO. : PD-68-86 Page 5 Accordingly and in consideration of the comments received, Staff would have no objections to the application as submitted and approval of the by-law * attached hereto. WHEREAS the Council of the Corporation of the Town of Newcastle deems it advisable to amend By-law 84-63, as amended, of the Corporation of the Town of Newcastle. NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the Town of Newcastle, enacts as follows: 1. Section 12.4, "Special Exceptions - Urban Residential Type One (Rl)" zone is hereby amended by adding thereto, the following new "Special Exception 12.4.17" as follows: "12.4.17 URBAN RESIDENTIAL EXCEPTION (R1-17) ZONE Notwithstanding Section 12.2, those lands zoned "R1-17" on the schedules to this by-law shall be subject to the following zone regulation: a) Lot Area (minimum) 2100 square metres" 2. Schedule "4" to By-law 84-63, as amended, is hereby further amended by changing to "(Rl-17)" the zone designation of the lands indicated as "Zone Change to R1-17" as indicated on the attached Schedule "X" hereto. 3. Schedule "X" attached hereto shall form part of this by-law. 4. This By-law shall come into effect on the date of passing hereof, subject to the provisions of Section 34 of the Planning Act.
