SUBJECT: REZONING APPLICATION - VELTRI AND SON LIMITED
PART LOT 35, CONCESSION 5, DARLINGTON
OUR FILE: DEV 86-2
RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration Committee
recommend to Council the following:
1 . THAT Report PD-64-86 be received; and
2 . THAT the application submitted by Veltri and Son Limited, to rezone a parcel of
land located in Part of Lot 35, Concession 5, former Township of Darlington to
permit the development of a Node/Cluster, be referred back to Staff pending
Council consideration of an application for an amendment to the Durham Regional
Official Plan.
BACKGROUND AND COMMENT:
IOn January 9, 1986 the Planning Department received an application for rezoning, from
* Veltri and Son Limited, which seeks to have Blocks "F" and "G" (see attached sketch) zoned
"Residential Cluster".

Staff would note for the Committee's information that, pursuant to Council's resolution of
July 26, 1982 and the requirements of the Planning Act, the appropriate signage
acknowledging the application was installed on the subject lands. Staff would note that,

resulting from the filing of the application, an adjacent property owner
requested further clarification of Staff with respect to the intention of
the application. Additionally, the neighbours concerns were submitted to
Staff by correspondence dated February 21, 1986.
In accordance with departmental procedures the application was circulated to
obtain comments from other departments and agencies as noted in Staff Report
PD-28-86. The following would summarize the comments as received.
Town of Newcastle Fire Department
"The Fire Department has no objection to the above-headed application.
Response would be from Station #4, located on Trull's Road. Water supply
would be fire department tank truck."

Town of Newcastle Building Department
"No objection."

Town of Newcastle Community Services
"In reference to the above rezoning application our department has no
objection and recommend cash-in-lieu of parkland dedication if applicable."

Town of Newcastle Works Department
"We have reviewed the above-noted application for rezoning and find that we
have no objections to the proposal provided that the applicant agrees to
contribute to the upgrading of Townline Road to the satisfaction of this
Department.
Secondly, it will be the applicant's responsibility to prepare a lot grading
and drainage plan and perform ditching along the frontage of the site to
ensure positive drainage of the site and the ditchwork."

"For the above application there are no objections to rezoning but if more
than four lots are to be proposed, then this department will require a soil

investigation report indicating percolation times and ground water table,
etc. We would also require a site plan indicating house, well and sewage
disposal locations."
Central Lake Ontario Conservation Authority
"Authority staff have no objection to the approval of the above-noted
application. Staff requests that the applicant be informed that all of the
property contained in the application is subject to Ontario Regulation
161/80 and a permit from this Authority is required prior to any filling or
grading."
Region of Durham Planning Department
"In response to your request for comments, we note that the subject property
is designated "Permanent Agricultural Reserve" in proposed Amendment No. 141
to the Durham Regional Official Plan, which Amendment was adopted by
Regional Council on January 15, 1985. The proposed non-farm residential
development is not permitted within this designation."
STAFF COMMENTS:
In view of the comments submitted by the Durham Regional Planning
Department, Staff, by correspondence, advised the applicant of their
response. Accordingly, it is Staff's understanding that the applicant has
submitted an application, through the Durham Regional Planning Department,
for an amendment to the Durham Regional Official Plan. Accordingly, Staff
would have no objections to the tabling of the application pending the
disposition of an amendment to the Durham Plan.
Staff would note for the Committee's information that with respect to the
concerns of the adjacent property owner the comments collectively of the
Town's Works Department, Durham Regional Health Unit and Central Lake
Ontario Conservation Authority, would be taken into consideration pending
the decision with respect to the Official Plan conformity of the
application.

SUBMISSION OF ADJACENT PROPERTY OWNER
"I object to these 2 lots being divided at this time.
About 25 (?) years ago East Whitby Township (now Oshawa) and Darlington
Township (now the Town of Newcastle) raised the Townline Road in front of
these two lots and installed a culvert diagonally from N.W. to S.E. During
spring run-off and heavy rains this brings the water from Oshawa onto these
two lots and then onto ours . At this time when the fields are covered in
snow this isn't apparent but if you will take a look at the snow piled on
the west side at the north end of the Townline and, keep in mind that a very
large portion of this will be channelled through these lots and then ours,
I'm sure you will agree that this heavy clay soil will not absorb four
septic beds. In previous years this was a sod farm and so, some of the top
soil has been removed.
At any time of year, the signs of erosion are here on our property even
though we have installed 2 catchbasins and drain the water back to the
ditch.
I think, before allowing more housing, the Town should change the culvert,
do a soil test and consult CLOCA who became involved when we added fill to
our property under Ontario Regulation 824/73. I would suggest that you
defer making a decision at this time and see for yourself what happens in
the spring run-off."
