SUBJECT: APPLICATION TO REMOVE THE HOLDING SYMBOL FROM THE "(H)R1" - URBAN
RESIDENTIAL TYPE ONE ZONE" - URBAN RESIDENTIAL TYPE ONE ZONE"
PART LOT 35, CONCESSION 2, DARLINGTON - FRAB INVESTMENTS LIMITED

RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration Committee
recommend to Council the following:
I. THAT Report PD-59-86 be received; and
2. THAT the application submitted by Frab Investments Limited, requesting the removal
of the (Il) Holding symbol from a parcel of land in Part of Lot 35, Concession 2,
* former Township of Darlington, be approved and that the attached by-law hereto be
forwarded to Council upon the Owner' s submission of a registered copy of the
Subdivision Agreement entered into between the Town of Newcastle and Frab
Investments Limited.
BACKGROUND AND COMMENTS:
On December 3, 1984 the Planning Department received an application, submitted by Frab
Investments Limited, requesting the removal of the (H) Holding provision on a parcel of
land located in Part of Lot 35, Concession 2, former Township of Darlington (see
* attached) .
As noted within Staff Report PD-7-85 acknowledging the application, the removal of the
Holding symbol shall be upon Council being satisfied that the uses to be permitted will be
adequately serviced, the lands to be used have adequate access, prior uses of the land
will not prevent the use of the land for the purposes intended by the by-law, that the

lands and proposed uses will be adequately protected from any physical or
man-made hazards and conditions associated with the lands, and that the
agreements in respect of such matters and the associated financial
requirements, where required, have been executed with the Town of Newcastle
and/or the Regional Municipality of Durham.
In accordance with departmental procedures, the application was circulated
to obtain comments from other departments and agencies as noted in Staff
Report PD-7-85. The following would summarize the comments received
pertaining to the application. j
Central Lake Ontario Conservation Authority
"The Authority Staff have concerns with the site relating to lot grading and

storm water runoff.
Providing the Authority comments on the subdivision application are
incorporated in the conditions of draft approval , the Authority Staff have
no objection to the rezoning of the above site."
Town of Newcastle Works Department
"We have reviewed this application for rezoning and find we have no
objection to this proposal provided that:
- The owner enter into a Development Agreement with the Town;

- Stormwater management principles, as outlined in the Courtice Stormwater
Management Study are incorporated in the engineering of this development
to the satisfaction of C.L.O.C.A. and the Director of Public Works;
- The Owner constructs a concrete sidewalk on Townline Road from the
proposed access road of this development to the proposed access road to
Remlark Holdings Limited property (File # 18T-79038) ;
- Any easements required by the Town be granted free and clear of any
encumbrances;
- All works are completed in accordance with the Town of Newcastle Design
Criteria and Standard Drawings;

- The owner complies with all requirements of the Public Works Department,
financial and otherwise. "

Region of Durham Planning Department
i ) "Further to your request for comments, we note that the subject property
is designated "Residential " in both the Durham Regional Official Plan
and the Official Plan for the former Township of Darlington Planning
Area. The proposed development of 12 single detached residential lots
conforms.
We will provide you with further comments when our investigation on
Regional roads is completed. "
ii ) "Further to our letter dated January 4, 1985, we wish to add the
following comments on Regional services and Regional road:
Sanitary Sewers
The existing 900 mm trunk sanitary sewer located on easement through
the subject property is too deep to permit direct connection for
service laterals. Therefore, the servicing of the subject proposal
will require the twinning of a small diameter sanitary sewer along the
trunk sewer and a connection of the two sewers at the eastern limit of
the subject property.

Watermains
Municipal water supply is available to the subject site from existing
watermains located on Townline Road South. The existing 40 min plastic
watermain located on an easement within the subject property should be
abandoned and reconnected at the eastern limit of the property.
Storm Sewers

A storm sewer outfall may be required from Townline Road easterly
through the subject property anad the Region will require access if the
construction of the outfall is to proceed.
Regional Road
We request that 14m x 9m sight triangles at the proposed intersection
of Townline Road South be conveyed free and clear of all encumbrances
to the Region."

STAFF COMMENT:
It is noted for the Committee' s information that on February 18, 1986,
five (5) copies of the required Subdivision Agreement, signed on behalf
of Frab Investments Limited, were submitted to Town Staff for execution

by the Town of Newcastle prior to the registration of same. Staff would
note that the agreement, as prepared, incorporates the comments/concerns of
the various departments and agencies as expressed through the subdivision
process and the rezoning application. Furthermore, Staff would note that
Durham Regional Planning Department advises that the Servicing Agreement, as
required, is presently being processed and accordingly, would have no
objections to the removal of the Holding symbol at this point in time.
In consideration of the above comments and upon the applicant submitting the
registered copy of the Subdivision Agreement, Staff would have no objections
* to the removal of the Holding symbol as shown on the attached by-law and
schedule thereto.
Staff would note for the Committee' s information that, pursuant to Section
35 of the Planning Act, a by-law amendment to remove a (H) Holding symbol is
not subject to the normal appeal period so afforded a standard rezoning
application and accordingly, is deemed final and binding as of Council ' s
approval of same.

BY-LAW NUMBER 86-
being a By-law to amend By-law 84-63, the Comprehensive Zoning
By-law of the Corporation of the Town of Newcastle.
WHEREAS the Council of the Corporation of the Town of Newcastle deems
it advisable to amend By-law 84-63, as amended, of the Corporation of
the Town of Newcastle.
NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of
the Town of Newcastle enacts as follows;
1. Schedule "4" to By-law 84-63, as amended, is hereby further
amended by changing the zone designation from "(H)R1-Urban
Residential Type One (R1)-Holding" to "R1-Urban Residential Type One
(R1)" Zone as shown on the attached Schedule "X" hereto.
2. This By-law shall come into effect on the date of passing
hereof, subject to the provisions of Section 35 of the Planning Act.

SUBJECT: REZONING APPLICATION - PAUL LANGLEY

RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration Committee
recommend to Council the following:
1. THAT Report PD-60-86 be received; and
2. THAT the application submitted by Mr. Paul Langley, to rezone a parcel of land
located in Part Lot 17, Concession 10, former Township of Darlington to permit the
construction of a single family dwelling be received and referred to Staff for
processing and a subsequent report and public meeting.
BACKGROUND AND COMMENT:
On February 20, 1986, the Planning Department received an application for rezoning from
Mr. P. Langley to permit the construction of a single family dwelling.
The application has been circulated, in accordance with departmental procedure, to various
agencies and Town departments for their comment. It is noted for the Committee's
information that, pursuant to the requirements of the Planning Act , the application has
been scheduled for a public meeting April 21 , 1986.

Accordingly, it is recommended that the application be received for
information and referred back to Staff for the preparation of a subsequent
report .
