That Report PD-103-85 be received; and 2. That the attached by-law exempting Lots 1, 2, 3 and 26 to 36 all inclusive, registered plan 1OM-761 from Part Lot Control ,be approved and forwarded to the Regional Municipality of Durham pursuant to Section 49, Subsection (7) of the Planning Act; and 3. That Mr. Smith be so advised. i i .. .2 l��h) REPORT NO. : PD-103-85 Page 2 BACKGROUND AND COMMENT: On June 20, 1985 Staff received a request from Mr. George Smith, acting on behalf of Halminen Homes, for an exemption from Part Lot Control in respect of Lots 2, 3, 35 and 36 in registered Plan of Subdivision IOM-761 . Staff have reviewed the request and would have no objection to approval of a by-law exempting the subject lands and all other * semi -detached lots within this Plan from Part Lot Control . In that regard, attached herewith is a by-law which requires approval of Council and the Regional Municipality of Durham which would exempt the subject lands from Section 49(5) of the Planning Act pursuant to the provisions of Section 49(7) of said Act. In order to facilitate conveyance of title of the individual semi -dwellings located on these lots, it would be appropriate for Council to approve the necessary exemption from Part Lot Control . Box 429 PORT PERRY, Ontario LOB 1NO I VCS) THE CORPORATION OF THE TOWN OF NEWCASTLE BY-LAW NUMBER 85- being a By-law to designate a certain portion of a Registered Plan as not being subject to Part Lot Control. WHEREAS the Council of the Town of Newcastle deems it desirable to exempt, from Part Lot Control, Lots 1, 2, 3, and Lots 26 to 36 (inclusive) of Plan 1OM-761, registered at the Land Registry Office for the Land Registry Division of Newcastle (No. 10) on February 5, 1985; NOW THEREFORE, the Council of the Corporation of the Town of Newcastle enacts as follows: 1. That Subsection (5) of Section 49 of the Planning Act shall not apply to those lands described in Schedule "A" to this by-law. 2. This by-law shall come into effect upon being approved by the Regional Municipality of Durham, and thereafter Subsection (5) of Section 49 shall cease to apply to the lands described in Schedule "A" hereto. 3. Schedule "A" attached hereto shall form part of this by-law. BY-LAW read a first time this day of 1985. BY-LAW read a second time this day of 1985. Registered Plan 1OM-761 Lots 1, 2, 3, .and 26 to 36 (inclusive) I
