SUBJECT: APPLICATION FOR REZONING - ROBERT L. STEVENS
PART LOT 14, CONCESSION 1 , BOWMANVILLE

RECOMMENDATION:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following :
I
1 . That Report PD-108-85 be received ; and
2. That the application submitted by Mr. Robert L.
Stevens to rezone a parcel of land in Part of Lot 14,
Concession 1 , former Town of Bowmanville, to permit
the development of a car wash establishment , be
approved, and that the by-law amendment attached
* hereto be forwarded to Council for approval .

BACKGROUND AND COMMENT:
On May 27, 1985 the Regional Land Division Committee approved an
application LD 163/85 - submitted by Mr. Robert L. Stevens. The
application was for consent to sever a parcel of land (3567.6
square metres) on which a car wash establishment was proposed. The
application was approved subject to several conditions consistent
with comments as provided for the Committee's information. In
reviewing the application staff noted that the lands in question to
be severed were designated "Industrial " within the Bowmanville
Urban Area Official Plan. Only uses of a general industrial nature
shall be permitted adjacent to or abutting existing or proposed
residential or commercial uses. The use of the subject land, as a
car wash, would appear to conform with the intent of the Official
Plan. Furthermore, Regional staff in reviewing the application ,
similarily noted that the property is designated "Industrial " in
the Durham Regional Official Plan and that the proposed car wash is
permitted provided that Newcastle Council determines it will have
no adverse affect on the abutting residential uses. Staff
indicated no objections to the severance subject to several
conditions, one being the final and binding approval of a rezoning
application to permit a car wash establishment on the subject
lands.
Accordingly, on April 18, 1985 the Planning Department received an
application submitted by Mr. Stevens to rezone a parcel of land
located in Part of Lot 14, Concession 1 , former Town of
Bowmanville, to permit a car wash establishment.
In accordance with departmental procedures, the subject application
was circulated to obtain comments from other departments and
agencies. In reviewing the application, -the Regional Planning and
Works Departments indicated no objections to same inasmuch as the
applicant through the severance application concurred with the
Region 's comments pertaining to the provision of services. The
Town Works Department had no objection, subject to the following:
1 ) that the applicant dedicate to the Town the 3.05 metre road
widening on Baseline Road, 2) that the applicant enter into a site
plan agreement with the Town , 3) that the applicant submit
engineering drawings of the site so staff may assess and comment on
same, 4) that all proposed works are completed in accordance with
the Town of Newcastle design criteria and standard drawings.
Staff would note for the Committee 's information that in
conjunction with the rezoning application, an application for site
plan approval was submitted for staff's review.

In addition to the above staff would note that the following
departments/agencies had no objections to the proposal . 1 )
Newcastle Hydro, 2) The Central Lake Ontario Conservation
Authority, 3) The Town Fire Department , 4) The Town Building
Department.
The application was circulated to the Ministry of Environment for
their review in consideration of the noise potential of such a use.
The Ministry did provide comment in May with respect to the
servicing of the facility, noting that inasmuch as it was serviced
by Town water and Regional sanitary sewer system, the Ministry had
no objections. Staff in further consultation with Ministry staff
was advised that any further comment, if applicable , with respect
to the "Air Application" would be forwarded for our information.
Staff advised the Ministry by correspondence that should no
additional comments be received prior to the public meeting of July
15, 1985, staff would anticipate the Ministry's concurrance with
the application. It is noted for Committee's information, that the
Ministry of Environment did provide staff with a copy of their
buffering guidelines. It is noted within same as pertaining to
residential - light industrial usage that a separation distance of
60 metres between residential buildings and industrial buildings
was considered an acceptable minimum. Example of light industrial
uses include light warehousing, electronics, light assembly, small
industrial malls and car wash establishment. Staff note that the
site plan application submitted provides an orientation of the
proposed building abutting Baseline and a separation distance from
the car wash in excess of 60 metres to the rear lot lines of the
residential lots to the north (fronting on Roser Crescent). Staff
note 'that the residential lots to the north have a depth of
approximately 45 metres (150 feet) with the dwelling units sited
towards the front portion of the lots.
Staff would note for the Committee 's information that the public
circulation of the rezoning application in consideration of Council
policy pertaining to the installation of public informational signs
re : a rezoning application and the requirements of the planning
act, re: notification and circulation to abutting land owners was
provided accordingly. In consideration of said circulations staff
received no objections to the proposal .
In consideration of the comments contained within said reports,
staff have no objections to the approval of the zoning by-law
* amendment, attached hereto, to permit the use of a car wash
establishment on the subject lands. It is furthermore noted for
the Committee's information that upon the receipt of the necessary

information with respect to the site plan application , staff will
continue the review of same.

THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW NUMBER 85-
being a By-law to amend By-law 84-63, as amended, of the Town of
Newcastle.
WHEREAS the Council of the Corporation of the Town of Newcastle deems
it advisable to amend By-law 84-63 as amended.
NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of
the Town of Newcastle enacts as follows:
1. Section 23.3 SPECIAL EXCEPTIONS - LIGHT INDUSTRIAL (M1) ZONE is
hereby amended by adding thereto the following new Special Exception
23.3.5 as follows:
"23.3.5 LIGHT INDUSTRIAL EXCEPTION M1-5 ZONE
Notwithstanding Section 23.1 those lands zoned M1-5 on the
schedules to this By-law, in addition to the uses permitted in
the M1 zone, may also be used for a car wash establishment."
2. Schedule "3" to By-law 84-63, as amended, is hereby further
amended by changing to "Ml-5" the zone designation of the lands
indicated as "ZONE CHANGE TO "M1-5" as indicated on the attached
Schedule "X" hereto.
3. Schedule "X" attached hereto shall form part of this By-law.
4. This By-law shall come into effect on the date of passing
hereof, subject to the provisions of Section 34 of the Planning
Act.
