That Report PO-113-85 and the minutes of the Committee of Adjustment meeting of July 3, 1985 be received for information. BACKGROUND AND COMMENT: For the information of the General Purpose and * Administration Committee, staff have prepared the attached list of applications to the Committee of Adjustment for the meeting of July 3, 1985. Murdoch APPLICATIONS: A 21/85 - Wayne- and June-Foster,- Lot. 18,. Concession-1,. Clarke- Application was made for relief from zoning by-law requirements in order to permit the applicant to construct a 624 sq. ft. accessory building which would exceed the maximum requirements of not more than 40% of the main building total floor area. Mr. Foster appeared in support of this application. No other person appeared in support of or in opposition to this application. Moved by Mrs. Payne seconded by Mr. Muir, "THAT as the proposed variance does not appear to offend the intent of the Official Plan or Zoning By-law and would not appear to have a detrimental effect on the surrounding properties, permission is GRANTED to construct a 624 sq. ft. accessory building, on condition the existing accessory building is removed. Application was made for relief from zoning by-law requirements in order to permit the applciant to construct a 576 sq. ft. accessory building which would exceed the maximum requirement of not more than 40% of the main building total floor area. Robert Whiteley appeared in support of this application. Several neighbours appeared with interest in this application. No other person appeared in support of or in opposition to this application. Moved by Mr. Reicheld, seconded by Mr. Rehder, "THAT as the variance appears to comply with the intent of the Official Plan and Zoning By-law and would not appear to have a detrimental effect on the surrounding neighbourhood, permission is GRANTED to construct a 576 sq. ft. accessory building. " "CARRIED" A 23/85_ -_Marion_ McKeen,. Lot_ 19,. Concession_ 5,_Darlington._ Application was made for relief from zoning by-law requirements in order to permit the applicant to expand a legal non-conforming use by construction of a hip roof over the existing non-conforming building. Mrs. McKeen appeared in support of this application. Mrs. Weales appeared asking if the yard would be cleaned up after construction of this roof. No other person appeared in support of or in opposition to this application. Moved by Mr. Muir, seconded by Mr. Reicheld, "THAT as the proposed expansion of a legal non- conforming use does not appear to offend the intent of the Official Plan or Zoning By-law and would not appear to have a detrimental effect on the surrounding neighbourhood, permission is GRANTED to construct a hip roof over the existing legal non-conforming building. This approval is conditional upon the lean-to at the rear of the building being removed end upon approval of a Site Plan Agreement with the Town of Newcastle.
