SUBJECT: TOWN OF NEWCASTLE SIGN BY-LAW
MINOR VARIANCE - GOODYEAR

RECOMMENDATION:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1 . That Report PD-114-85 be received; and
2. That Goodyear Canada Inc. be granted a variance from
the Town of Newcastle Sign By-law to permit a maximum
Of three (3) off-site directional signs conditional
upon a maximum of two (2) being located within a
residential zone and further, conditional upon the
approval of the Director of Public Works in respect
of sign location and satisfying all the requirements
of the Town of Newcastle Sign By-law in respect of
permits.

BACKGROUND AND COMMENT:
On June 26, 1985 the Town of Newcastle Public Works Department
received a request from Goodyear Canada Inc. for permission to
erect three (3) signs for the purposes of informing transport
drivers and other visitors of the location of the Goodyear plant.
The Town of Newcastle Sign By-law permits a maximum of two (2)
off-site directional signs and prohibits such signs from being
located within a residential zone. Two (2) of the three (3) signs
being proposed by Goodyear would be located within residential
zones at Goodyear's Queen Street entrances , hence the necessity
for a variance from the Town 's By-law.
Pursuant to the provisions of a recent amendment to the Municipal
Act, the Council may, upon the application of any person ,
authorize a minor variance from the provisions of by-law passed
pursuant to Paragraph 141 , Section 210 of the Municipal Act (Sign
By-law) provided that, in the opinion of the Council , the general
intent and purpose of the by-law are maintained. This provision
permits Council to consider such applications for variances from
the Sign By-law.

Staff briefly discussed this provision of the Act with the Town
Solicitor to ascertain whether or not this was a matter that must
be dealt with by Council or could be referred to the Committee of
Adjustment. He offered the opinion that the legislation was quite
specific and the request for a variance from a Sign By-law could
only be dealt with by the Council and, that there were no public
notice or appeal procedures provided for in such a situation.
Staff have considered the request of Goodyear Canada and, given
the fact that there are no opportunities for Goodyear to locate
these directional signs within anything but a residential zone,

bearing in mind the location of the plant , Staff would have no
objection to Council granting a variance to the Sign By-law
subject to the limitation that no more than two (2) of the three
(3) proposed signs are to be located in a residential zone, and
further, conditional upon receiving the written approval of the
Director of Public Works with respect to the actual location of
the signs and completing any necessary permit applications and
payment of applicable permit fees.
