That Report PD-125-85 be received; and 2. That the Liquor Licence Board of Ontario be advised that the Town of Newcastle has no objection to the elimination of bedroom facilities and that the reclassification of the premises from "Hotel " to "Tavern" would not contravene the provisions of the Town's Zoning By-laws. . . .2 REPORT NO.: PD-125-85 Page 2 BACKGROUND AND COMMENT: * On August 16, 1985, Planning Staff received the attached correspondence from the Liquor Licence Board of Ontario advising that the Castle Hotel , located at the corner of King and Division Streets, Bowmanville, has made application for a reclassification from "Hotel " to "Tavern" and to eliminate guest bedroom accommodations. In reviewing this matter, Staff would note the use of the subject property as a "Hotel " is not listed as a permitted use, however, enjoys the status of legally non-conforming use. The use of the subject property as a "Tavern" is listed as a permitted use and, therefore, conforms to the Town's Zoning By-law. With respect to the elimination of bedrooms, it would not appear to contravene the provisions of the Town's Zoning by-law providing the establishment complies to meaning of and licenced as a "Tavern" under The Liquor Licence Act as amended. BOX #41 BOWMANVILLE, Ontario Licence No. 011119 The licencee, in respect of the above noted establishment, has made application to this Board for reclassification from a Hotel to that of a Tavern and to eliminate guest bedroom accommodations, in accordance with Regulations under the Liquor Licence Act. In order that we may consider the application in accordance with the provisions of the Regulations, will you kindly provide the Board with the following information. (a) whether such reclassification would be in contravention of zoning or other municipal by-laws or legal authority; (b) whether the elimination of bedroom accommodations would effect the needs and wishes of the community; (c) provide this Board with a copy of a resolution of municipal council approving, if such is the case, the closing of the bedrooms in the Hotel.
