SUBJECT: REZONING APPLICATION - A. HOFSTEDE
PART LOT 17, CONC. 1, GEOGRAPHIC TWP. OF DARLINGTON

RECOMMENDATION:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
I . That Report PD-140-85 be received for information;
and
2. That appropriate direction be provided to Staff with
respect to the subject application for rezoning.

BACKGROUND AND COMMENTS:
On September 16, 1985, the General Purpose and Administration
* Committee considered Staff Report PD-131-85 (copy attached) in
respect of the subject application for rezoning. The Staff
recommendation was for denial , however, as a result of the
Committee' s consideration, the matter was referred back to Staff
for further dialogue with the applicant.

On September 23, 1985, Staff met with Mr. & Mrs. Hofstede to
review their proposed severances and, at that time, it was
indicated to Staff that they would have no objection to any
modification to the proposed lot lines necessary to permit the
requested rezoning and severances.
At the Committee meeting some concern was expressed about the
fact that the original proposal would create three (3) long,
narrow lots and Staff interpreted this as being a request to
examine alternative lot configurations. In that regard, we feel
it would be possible to create three (3) lots, two (2) of which
would be roughly 100 feet by 330 feet deep and the third lot
containing the applicant's existing residence occupying the
remainder of the property without unnecessarily restricting the
future development potential of the rear portion of the lands. A
* copy of the possible lot configuration, is attached for the
Committee' s information.
In addition to the concerns expressed by Members of Council , a
concern was identified by Mr. Watson, the abutting property owner
to the west, relative to noise and effects of spray. While Staff
feel that these are valid concerns which support our original
recommendation for denial , should Council wish to approve the
application, it would be appropriate to specify an increased
sideyard in an attempt to reduce any possible impacts.
* Attached for the Committee' s consideration is a possible by-law
amendment should Committee deem approval of this application to
be appropriate.

THE CORPORATION OF THE TOWN OF NEWCASTLE ---�
BY-LAW NUMBER 85-
being a By-law to amend By-law 84-63, as amended, of the
Corporation of the Town of Newcastle.
WHERLAS the Council of the Corporation of the Town of Newcastle deems
it advisable to amend By-law 84-63, as amended, of the Corporation of
the Town of Newcastle.
NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of
the Town of Newcastle enacts as follows:
1. Schedule "1" to By-law 84-63, as amended, is hereby further
amended by changing to "RC-6" the zone designation of the lands
indicated as zone change to "RC-b" on the attached Schedule "X"
hereto.
[. Section 7.3 of By-law 84-63, as amended, is hereby further
amended by adding thereto the following new subsection 7.3.6.
"7.3.b RURAL CLUSTER EXCEPTION (RC-6) ZONE
Notwithstanding Section 7.2 those lands zoned RC-6 on
the schedules to this by-law shall be subject to the
following zone regulations:
a. Interior Sideyard (minimum) 7.5 metres
except that the water surface area of any swimming "
pool may not be located closer than 30 metres from
any lot used for agricultural purposes.
3. Schedule "X" attached hereto shall form part of this
by-law.
4. This By-law shall come into effect on the date of passing
hereof, subject to the provisions of Section 34 of the Planning Act.
