MEETING OF OCTOBER 21, 1985

SUBJECT: SUMMARY OF COMMITTEE OF ADJUSTMENT
APPLICATIONS FOR MEETING OF SEPTEMBER 4, 1985
RECOMMENDATION:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the
following:
1 . That Report PD-142-85 and the minutes of the
Committee of Adjustment meeting of September 4,
1985 be received for information.
BACKGROUND AND COMMENT:
For the information of the General Purpose and
* Administration Committee, staff have prepared the attached
list of applications to the Committee of Adjustment for the
meeting of September 4, 1985. This list includes the file
number, applicant' s name, site location, type of variance
requested, Official Plan conformity, By-law conformity,
staff's comments on the applications, and the Committee of
Adjustment's decision.

APPLICATIONS:
A 34/85 - Mildred Martha Dent, Lot 28, Concession 5, Clarke.
Application was made for relief from zoning by-law requirements in
order to permit the applicant to create a parcel of land with a
frontage of 16.04 m (50 ft. ) , instead of the required 20 m frontage.
No person appeared in support or in opposition to this application.
Moved by Mrs. Payne, seconded by Mr. Reicheld,
"THAT due to the fact the variance would not
appear to offend the intent of the Official Plan
and Zoning By-law or have a detrimental effect
on the surrounding properties and as the
severance is to meld with the abutting property,
the variance is considered minor and permission
is GRANTED to create a lot with a frontage of
50 feet. "

Committee of Adjustment Meeting, September 4, 1985. . . . . . x`
A 35/85 - Victor and Ann White, Lot 35, Concession 5, Darlington.
Application was made for relief from zoning by-law requirements in
order to permit the applicant to construct an addition to an
existing legal non-conforming agricultural building, leaving a side
yard of 28 feet, instead of the required 15 m (49.21 ft. ) side yard.
Mrs. White appeared in support of this application. Mr. I . Hamilton
appeared, representing the neighbours, Mr. and Mrs. Anderson in
opposition to the application. Mr. Hamilton stated that they did
not believe the acerage was large enough to support an agricultural
operation and that they believe the addition is not intended to be
for an agricultural use. No other person appeared in support of or
in opposition to this application.
Moved by Mr. Murdoch, seconded by Mr. Muir,
"THAT as the construction of the proposed addition
would allow the applicant to enlarge and improve
the existing barn and, due to the location of the
barn, would not appear to have a detrimental effect
of the surrounding properties, permission is
GRANTED to expand a legal non-conforming agricultural
building encroaching a further 7 feet into the legal
non-conforming side yard, and leaving a 28 ft. side
yard."

A 36/65 - Wilma Lovekin, Lot 11 , Concession 1 , Bowmanville.
Application was made for relief from zoning by-law requirements in
order to permit the applicant to continue the use of a lot with an
existing single family dwelling having a rear yerd of 9.84 feet (2.9m) ,
instead of the required 7.5 m rear yard.
Mrs. Kay and Mr. and Mrs. Shaw appeared with interest in this application.
No other person appeared in support of or in opposition to this application.
Moved by Mr. RE:hder, seconded by Mr. Reicheld,
"THAT as the variance does not offend the intent
of the Official Plan or Zoning By-law and as the
severance of the abutting lot changes the existing
conforming side yard to a non-conforming rear yard
without changing the location of the existing
dwelling, the variance is considered minor in
nature and therefore permission is GRANTED to
continue the use of a single family dwelling
with a 9.84 ft. rear yard. "

Moved by Mr. Murdoch, seconded by Mrs. Payne,
"THAT the minutes of the last meeting be approved
