SUBJECT: REZONING APPLICATION - JANET MAYER
PART LOT 14, CONCESSION 8, FORMER TWP. OF DARLINGTON

RECOMMENDATIONS:
1. THAT Report PD-162-85 be received; and
2. THAT application for rezoning, File: DEV 85-26, in
respect of Part of Lot 14, Concession 8, former
Township of Darlington, submitted by Mrs. Janet Mayer,
to permit. the development of a residential lot having a
minimum lot area of 0.3 hectares be approved and that
* the attached by-law to amend Zoning By-law 84-63, as
amended be forwarded to Council for approval .

BACKGROUND AND COMMENT:
On August 28, 1985, the Planning Department received an application
submitted by Mrs. Janet Mayer to rezone a parcel of land located in
Part of Lot 14, Concession 8, former Township of Darlington. The
submission of the rezoning application was to permit the
development of a residential lot having a minimum lot area of 0.3
hectares.
Within the Durham Regional Official Plan, the subject property is
located within Hay don, a designated Hamlet. Section 10.4.1.4 of
the Durham Regional Official Plan stipulates that minor infilling
and/or minor additions to existing development are permitted in
Hamlets. Within the Development Plan for the Hamlet of Haydon, the
subject property is designated as "Residential Infilling", allowing
for one additional lot. Staff will expand upon the requirements of
the Hamlet Plan within the "Staff comments" of this report.
Staff would note for the Committee's information that the public
information signs, as required pursuant to Council 's resolution of
July 26, 1982 and the requirements of the Planning Act, were
installed on the subject lands.
In accordance with departmental procedures, the subject application
was circulated to obtain comments from other departments and
agencies. The following would summarize the comments as received.
In responding to the application, the Town Building Department,
Fire Department, Ministry of Agriculture and Food, and the Central
Lake Ontario Conservation Authority provided no objections to the
applications. The comments of the Durham Regional Health Unit and
Durham Planning Department are as follows:

"The above application for rezoning has been investigated by
this Health Department, and insofar as health matters are
concerned, there are no objections to its approval ."
Durham Regional Planning Department
"In responding to your correspondence dated September 9, 1985, we
note that the subject property is located within Haydon, a
designated Hamlet in the Durham Regional Official Plan. Section
10.4.1.4 of the Durham Plan stipulates that minor internal
infilling and/or minor additions to existing development are
permitted in Hamlets. In the development plan for the Hamlet of
Hay don the subject property is designated as "Residential
Infilling" where only one additional lot is allowed. Generally,
the minimum lot size for a new residential lot is 0.5 hectares.
However, Section 4.2 of the Development Plan stipulates that
Council may approve a reduction to 0.3 hectares if such is
warranted and shown to have no adverse effects on existing private
water supply and sewage disposal systems as confirmed in a detailed
Engineering Report. The proposed reduction of lot area would,
therefore, conform if it meets the requirements of Section 4.2 of
the Development Plan."
STAFF COMMENTS
As noted within the Regional Planning Department's comments, the
subject lands within the Hamlet Development Plan are designated
"Residential Infilling" - permitting one (1 ) additional lot.
Section 4.2 within the Hamlet Plan states as follows:
"Notwithstanding any provision of this Plan to the
contrary, an application for development by registered
Plan of Subdivision or by consent shall be accompanied by
a detailed Engineering Report based on test drilling which
confirms (1) soil conditions satisfactory for the
effective operation of a private waste disposal systems;
and (2) no adverse effects upon existing water supplies
and an adequate supply of potable water to service the
proposed development; and (3) an adequate separation
between water table and septic tile fields. If after

conducting the above investigation, evidence,
satisfactory to the Town of Newcastle and the Durham
Regional Health Unit, has been produced which indicates
that a reduction in the minimum lot area requirement is
warranted, Council may approve such a reduction only so
far as the minimum lot size is not reduced to below 0.3
hectares."
To that end, a report was prepared on behalf of the applicant by
Gibson and Associates Limited - Consulting Geotechnical Engineers.
A copy of this report was forwarded to the Regional Health Unit and
Planning Department for their review and comment. Staff would note
that no objections were provided by either Department in responding
to the application. Based on the findings of the site examination,
it was the opinion of Gibson and Associates Limited that the
proposed lot is suitable for rural residential development having a
private water well and waste disposal system. As noted previously,
the provisions of the Hamlet Development Plan did permit for one
(1) additional lot.
Staff would have no objections to the rezoning application reducing
the lot area to 0.3 hectares. Furthermore, it is noted that,
should Committee and Council approve the application, as a
condition of severance Staff would request of the Land Division
Committee that the Regional Health Unit approval for a well and
septic system be consistent with the Soils Report prepared by
Gibson and Associates Limited dated August, 1985.

BY-LAW NUMBER 85-
being a By-law to amend By-law 84-63, the Comprehensive Zoning
By-law of the Corporation of the Town of Newcastle.
WHEREAS the Council of the Corporation of the Town of Newcastle deems
it advisable to amend By-law 84-63, as amended, of the Corporation of
the Town of Newcastle.
NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of
the Town of Newcastle enacts as follows:
1. Schedule "11" to By-law 84-63, as amended, is hereby further
amended by changing the zone designation from "Residential Hamlet
Exception (RH-1)" to "Residential Hamlet (RH)" as shown on the
attached Schedule "X" hereto.
2. This By-law shall come into effect on the date of passing
hereof, subject to the provisions of Section 34 of the Planning Act.

PUBLIC MEETING CONCERNING A PROPOSED
ZONING BY-LAW AMENDMENT
TAKE NOTICE that the Council of the Corporation of the
Town of Newcastle will hold a public meeting on November 4,
1985 at 9:30 a.m. at Courtroom #2, Bowmanville Courthouse,
132 Church Street, Bowmanville, Ontario to consider a
proposed zoning by-law amendment under Section 34 of the
Planning Act.
The proposed zoning by-law amendment would change the zone
category of a 0.3 hectare (0.74 acre) parcel of land located
in Part of Lot 14, Concession 8, former Township of
Darlington (as shown below) from "Residential Hamlet (RH)" to
a Hamlet Residential Special Exception Zone.
The proposed zoning change would permit the development of a
residential lot with a minimum lot area of 0.3 hectares.
ANY PERSON may attend the public meeting and/or make
written or verbal representation either in support of or in
opposition to the proposed zoning by-law amendment.
ADDITIONAL INFORMATION relating to the proposed zoning
by-law amendment is available for inspection between 8:30 am.
and 4:3U p.m. at the Planning Department, Municipal Offices,
Hampton, Ontario.
