THAT Report PD-163-85 be received; and 2. THAT Council adopt the following resolutions: (I ) "That Council of the Town of Newcastle hereby requests the Minister of Municipal Affairs and Housing to extend the draft plan approval for subdivision 18T-24002 for a further one (1) year period to January 26, 1987"; and ( II ) "That Council of the Town of Newcastle hereby requests the Minister of Municipal Affairs and Housing to extend the draft plan approval for subdivision 18T-75362 for a further one (1) year period to January 23, 1987"; and (III) "That Council of the Town of Newcastle hereby requests the Minister of Municipal Affairs and Housing to extend the draft plan approval for subdivision 18T-77001 for a further one (1) year period to January 28, 1987"; and 3. THAT the requests in Recommendation No. 2 above, be forwarded to the Ministry of Municipal Affairs and Housing and that the respective owners be so advised. �u C• ) REPORT NO. : PD-163-85 Page 2 BACKGROUND AND COMMENT: On October 22, 1985 Staff received copies of a letter, addressed to each respective applicant/agent, from the Ministry of Municipal * Affairs and Housing (see attached) noting that each draft approval would lapse in January of 1986. Staff would note for the Committee's information that in respect of files 18T-77UU1 - Schleiss and Holland, and 18T-75362 - Burketon Hills, each are developing in phases and accordingly, require an extension for that portion which has not been included in present phase development. With respect to file 1817-24002, Staff would note that the Owner has recently submitted a draft subdivision agreement for Staff's review and has indicated that it is his intention to proceed with the development of the Plan, however, does not feel that the necessary steps may be completed prior to the expiry date. Accordingly and in consideration of the above, Staff would have no objections to the approval of a further one (1) year extension in draft approval for each plan of subdivision as noted within Staff's recommendations. i espectf ly'"bmitted, T. . If you are interested in pursuing final approval please send us a request for draft approval extension, with reasons , in advance of the lapsing date, with copies to the municipal and regional planning departments. In order to identify any potential problems I recommend that you also discuss the extension with the municipal planning department. By a copy of this letter we are asking the municipality and the region to advise us of their position on your request. If we do not hear from them we will assume they have no objection. If there are any concerns with the requested extension we will contact you in advance of the lapsing date. Please remember that once draft approval has lapsed, it cannot be reinstated.
