BUILDING PERMIT FOR ADDITION TO EXISTING DWELLING
RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1. THAT Report PD-85-88 be received; and
2. THAT Staff be authorized to issue the building permit for the addition to
the existing dwelling on Lot 3, Plan 1OM-774 forthwith.
BACKGROUND AND COMMENT:
In reviewing a recent building permit application to permit the construction of an
addition to a dwelling unit, Staff has confirmed that the existing dwelling unit
which had be incorporated within draft Plan 18T-84048, now Lot 3 on Plan 1OM-774,
does not comply to the rearyard and interior sideyard setback provisions within the
"RE-4" Zone in By-law 84-63. Staff would note that the dwelling unit, as
illustrated on the draft plan, did comply with the above-noted yard requirements.
However, in preparing the 1OM-Plan for registration, the rear lot line was altered as
per the conditions of the Central Lake Ontario Conservation Authority. Additionally,
the most easterly lot line was altered on the 1OM-Plan. The resulting lot

configuration and in consideration of the location of the dwelling unit
resulted in the non-compliance.
Staff would note that when a 10M-PIau is prepared, existing buildings and
structures are not abovmn thereon. Notwithstanding the above, Staff would note
that a building permit, submitted by a previous mwuec' was issued for
renovations to the existing home in September, 1986.
The present addition as proposed complies with the applicable provisions of
By-law 84-63. Staff is respectfully requesting Committee's consideration to
permit the issue of the building permit for the addition. Pending same, an
application to the Committee of Adjustment in consideration of the reocyard and
aideyard setback would be submitted.
