SUBJECT: REDESCO INC. - PRESERVICING REQUIREMENTS
PART LOT 35, CONCESSION 2, DARLINGTON

RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1. THAT Report PD-204-88 be received; and
2. THAT the request, submitted by D.G. Biddle and Associates Ltd. on behalf of
Redesco Inc. to proceed with the preservicing of Subdivision 18T-87019 be
approved subject to the conditions set out in Attachment No. 1 attached
hereto; and
3. THAT the applicant be so advised.
1. BACKGROUND
1.1 As Committee may recall, Council, at their December 14, 1987 meeting,
approved draft Plan of Subdivision 18T-87019 located within Part of Lot 35,
Concession 2, former Township of Darlington. Subsequently thereto, a copy
of said resolution and report was forwarded to the Regional Municipality of
Durham for their information and action thereon.

1.2 Staff would note that draft approval was issued by Regional Staff on
February 22, 1988.
2. STAFF COMMENTS
2.1 Staff, by correspondence received September 20, 1988, have been requested to
consider the applicant's request to proceed with the preservicing aspects of
the subdivision.

2.2 The Town of Newcastle Works Department advises that the approval of the

Engineering Drawings, although not completed to date, are expected to be
finalized within the near future. Pending receipt of same, they have no
objections to the preservicing request.

2.3 Staff, in considering the applicant's request, would note for the
Committee's information that the approval of the Engineering Drawings
complete one aspect of the Subdivision Agreement and formalizes the basic
information for other Schedules within the Agreement pertaining to the
development and costs thereto.
2.4 Accordingly, and in consideration of the above, Staff would respectfully
recommend that, should Committee concur with D.G. Biddle's request, any
preservicing be subject to the conditions as set out in Attachment No. 1 to
this Report.

ATTACHMENT NO. 1 TO
REPORT PD-204-88
1. That an appropriate Letter of Credit, performance bond or cash or certified
cheque for the amount of security required by the Town be delivered to the
Town.
2. That a letter be delivered to the Town whereby the Town is held harmless for
any failure to execute a Subdivision Agreement; and that the letter further
state that the Town may draw on the Letter of Credit, performance bond or
cash to re-imburse it for expenses that may be incurred as a result of
non-performance by the subdivider.

3. That the subdivider provide the Town with verification that he has insured
against all damages or claims for damages. The policy shall insure the Town
with inclusive limits of not less than $3,000,000.00 in accordance with the
terms set out in the Town's standard Subdivision Agreement.
4. That the Engineering Drawings have been approved to the satisfaction of the
Director of Public Works.
5. That the approval of the Central Lake Ontario Conservation Authority shall be
obtained pertaining to an erosion and sedimentation control plan prior to the
commencement of site preparation.

Dear Sir:
On behalf of Redesco Inc., the developer of the noted lands, we
respectfully request that the Town permit the construction of Town
services for this development prior to the execution and registration of the
Subdivision Agreement.
Due to the fast approaching end to this construction season, the developer
is anxious to have construction proceed prior to restrictive weather
conditions.
We understand that due to the current workload on Town staff, it may not
be possible to have a Subdivision Agreement in place for the current
construction season.
Please advise at your earliest convenience on this matter.
