RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1. THAT Report PD-210-88 be received; and
2. THAT the rezoning application to implement conditions of draft approval for
Subdivision 18T-85013 (Abek Real Estate - G.M. Sernas) be approved and the
by-law forwarded to Council; and
3. THAT the applicant's agent and the Region of Durham Planning Department be
so advised.
1. BACKGROUND
1.1 On Monday, February 15, 1988 Committee considered Staff Report PD-44-88
recommending approval of Plan of Subdivision 18T-85013. Subsequently,
Council endorsed Committee's recommendation approving fifty-four (54) lots
for single family dwellings and two (2) Blocks for open space.

l.% Through the circulation process Canadian Pacific Rail had noucecoo
with respect to noise, vibrations etc. and request a thirty (30) metre
setback from C9 Bail right-of-way. Subsequently, Condition 13 of the
Conditions of Draft Approval stated that a 30 metre setback from the
right-of-way be established through the Zoning By-law on Lots 35-29'
38-42, and 45-56 on Plan 18T-85013 (copy attached) .
3. PUBLIC NOTICE
%.I Staff would note for the Committee's information that pursuant to
Council's resolution of July 26' 1982 and the requirements of the
Planning &rL, the appropriate oigmage acknowledging the application
was installed on the subject lands.
3. CIRCULATION
3.1 In accordance with departmental procedures, the application was
circulated to obtain comments from other agencies/departments. Staff
would note that the following agencies offered no objection:
- Newcastle Public Works Department
- Regional Planning Department
- CP Rail
4. STAFF COMMENTS
4.1 Staff would note for the Committee's information that the zoning
implements conditions of draft approval and the Subdivision Agreement
being Condition 0o. 13. Accordingly, Staff would offer no objection.

THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW NUMBER 88-
being a By-law to amend By-law 84-63, the Comprehensive Zoning By-law of
the Corporation of the Town of Newcastle.

WHEREAS the Council of the Corporation of the Town of Newcastle deems it
advisable to amend By-law 84-63, as amended, of the Corporation of the Town
of Newcastle.
NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the
Town of Newcastle enacts as follows:
1. Section 12.4 "Urban Residential Type Two Exception (R2)" zone of
By-law 84-63, as amended, is hereby further amended by adding thereto the
following new Subsection 13.2.4 as follows:

"13.2.4 URBAN RESIDENTIAL TYPE TWO EXCEPTION (R2-5) ZONE
Notwithstanding Section 13.2, those lands zoned "(R2-5)" on the .
Schedules to this By-law are also subject to the following zone
regulations:
a) Setback from the Canadian
Pacific Railway Right-of-Way (Minimum) 30 Metres
2. Schedule "X" attached hereto shall form part of this By-law.
3. This By-law shall come into effect on the date of passing hereof,
subject to the provisions of Section 34 of the Planning Act.
BY-LAW read a first time this day of 1988
BY-LAW read a second time this day of 1988
BY-LAW read a third time and finally passed this day of
1988.

PURPOSE AND EFFECT
BY-LAW 88-
FILE: DEV 88-91 (ABEK REAL ESTATE CORPORATION)
The PURPOSE AND EFFECT of By-law 88- is to amend Zoning By-law
84-63, as amended, of the Town of Newcastle by changing the zone
designation of the lands identified by Schedule "X" hereto from
"Urban Residential Type Two (R2)" Zone to "Urban Residential
Exception Type Two (R2-4)".
The subject By-law would establish a 30 Metre setback from the
Canadian Pacific Rail right-of-way.
