By-Law # MEETING: General Purpose and Administration Committee DATE: Monday, October 17, 1988 I REPORT #: PD-212-88 FILE #: DEV 88-30 SUBJECT: REZONING APPLICATION - WILLIAM DANIEL PART LOT 15/16, CONCESSION 11 FORMER TOWN OF BOWMANVILLE FILE: DEV 88-30 WREF: 18T-88046) i RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD-212-88 be received; and 2. THAT the application to amend the Town of Newcastle Comprehensive Zoning I By-law 84-63, as amended, submitted by William Daniel on behalf of West Bowmanville Developments Ltd., be referred back to Staff for further processing and the preparation of a subsequent report upon receipt of all outstanding comments; and i 3. THAT a copy of Council's decision be forwarded to the applicant and the i interested parties indicated hereto. 1. BACKGROUND 1.1 In June, 1988, the Town of Newcastle Planning and Development Department received an application to amend the Town of Newcastle Comprehensive Zoning i By-law 84-63, as amended. The application was submitted by William Daniel on behalf of West Bowmanville Developments Ltd. The rezoning would permit the development of 53.341 ha (132 acres) parcel through Plan of Subdivision, north of Baseline Road, west of Martin Road and south of the Canadian Pacific Railway right-of-way... . . .2 /V \�r _______________________________________________________________________________ 1.2 The proposal consists of 348 Low Density Residential units (single and semi-detached dwellings) ; three (3) Medium Density BIVoka consisting of approximately 310 units; two (3) High Density Blocks representing 276 apartment units; three (3) School Blocks (one secondary and two elementary) ; a Neighbourhood Park; a Daycare Centre; and a Block for Neighbourhood Commercial development. 1.3 Staff would note for the Committee's information that, pursuant to Council's resolution of July 26" 1982 and the requirements of the Planning Act, the appropriate oiguage acknowledging the application was installed on the subject lands and, surrounding property owners were advised of the proposal. 2. OFFICIAL PLAN CONFORMITY 2.1 Within both the Durham Regional Official DIao and the Town of Newcastle Official Plan (Bo»m\aoville Major Urban Area) , the subject property is designated "Residential" and "Minor Open Space and Hazard Lands". The Regional Official gIao policies permit the establishment of convenience stores compatible with surrounding uses; certain public and recreational uses; community uses such as day care centres, ' schools and parks, subject to the appropriate requirements in the respective restricted area (zoning) by-law. 2.2 Within the Tzvnno Official DIao this development falls into Neighbourhood 113B^. The Official Plan projects an overall population of 5800 for this neighbourhood, and the plan proposes a total of 930 units, which translates to a population of 2790. Also within this neighbourhood are two (2) Medium Density and a High Density designation. As well, a Neighbourhood Pack; o 'ouioc DobIio elementary school; a senior public elementary school; and a neonudocy school have been designated to develop within this neighbourhood. The proposal therefore appears to comply with the Newcastle Official Plan in terms of the development proposed. V() REP-OR No* . CIRCULATED AGENCIES 3.1 To date, comments remain outstanding from twelve (12) of the circulated agencies: Newcastle Public Works Department, Newcastle Community Services Department; Central Lake Ontario Conservation Authority; both the Public and Separate School Boards; Regional Public Works Department; the Ministry of Transportation; Ministry of Natural Resources; Ministry of Environment; Ontario Hydro; and C.P. Rail. 3.2 The agencies which have commented to date have not raised any objection to the proposed subdivision. Regional Planning has also noted no objection at this time, but will provide further comments on the servicing implications at a later date. 3.3 Staff note that numerous residents have viewed the development proposal at the Hampton office and have expressed concern regarding the proposed location of the high density residential in terms of their proximity to existing residential development on Penfound Drive and Walbridge Court. 4. STAFF COMMENTS 4.1 Comments received to date have not raised any objection to the proposal. As well, Staff note the application appears to be in compliance with the policies of both the Durham Regional official Plan and the Town of Newcastle Official Plan. 4.2 Staff note that Site Plan approval will be required prior to development taking place on the proposed commercial, day care, High Density and Medium Density blocks. Site Plan approval requires a detailed landscaping plan, provisions for privacy fencing and screening, parking and building elevations, among other standard requirements. 4 REPORT NO PD-2-2-88 PAGE 4 ------------------------------------------------------------------------------- 5. RECOMMENDATION As the purpose of this report is for the Public Meeting as required under the Planning Act and in consideration of the number of comments which remain outstanding and the number of concerns expressed by area residents, Staff are not presently in a position to make final recommendation on said application. Therefore, it is recommended that at such time as all the outstanding comments are received and the Plan of Subdivision is ready to be finalized, Staff will report back to Committee and Council with a recommendation on said application.
