REPORT File Res. ay-Earl # MEETING: General Purpose and Administration Committee DATE: Monday, October 17, 1988 REPORT #: PD-214-88 FIE #: DEV 88-59 aRECT: REZONING APPLICATION - WILLIAM DANIEL PART LOT 171, CONCESSION 1, FORMER TOWN OF BOWMANVILLE FILE: DEV 88-59 WREF: 18T-88047) RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD-214-88 be received; and 2. THAT the application to amend the Town of Newcastle Comprehensive Zoning By-law 84-63, as amended, submitted by William Daniel on behalf of West Bowmanville Developments Ltd., be referred back to Staff for further processing and the preparation of a subsequent report upon receipt of all outstanding comments; and 3. THAT a copy of Council's decision be forwarded to the applicant and the interested parties indicated hereto. 1. BACKGROUND 1.1 In June, 1988, the Town of Newcastle Planning and Development Department received an application to amend the Town of Newcastle Comprehensive Zoning By-law 84-63, as amended. The application was submitted by William Daniel on behalf of West Bowmanville Developments Ltd. The rezoning would permit the development of a 29.85 ha (73.8 acres) parcel through Plan of Subdivision, south of Highway No. 2, west of Green Road and north of the CP Rail right-of-way. 2 1.2 The proposal consists of 332 LOW Density Residential units (single and semi-detached dwellings) ; Eight (8) Medium Density Blocks consisting of sixty-two (62) units; a 2.73 ha Neighbourhood Park; and two (2) Blocks totalling 2.93 ha shown for future development of Highway 1.3 Staff would note for the Committee's information that, pursuant to Council's resolution of July 26, 1982 and the requirements of the Planning Act, the appropriate signage acknowledging the application was installed on the subject lands and, surrounding property owners were advised of the proposal. 2. OFFICIAL PLAN CONFORMITY 2.1 Within both the Durham Regional official Plan and the Town of Newcastle official Plan (Bowmanville Major Urban Area) , the subject property is designated "Residential". The Regional official Plan policies permit the establishment of a park within the "Residential" designation, subject to the appropriate requirements in the respective restricted area (zoning) by-law. 2.2 Within the Town of Newcastle Official Plan this development is proposed for Neighbourhood 113C11. The official Plan projects an overall population of 2500 for this neighbourhood. The application proposes a total of 394 dwelling units, which calculates to a population of approximately 1182. The Medium Density and Neighbourhood Park proposed within this development are also consistent with the symbols shown in the Official Plan. 2.3 Staff notes that abnold the applicant wish to proceed with a oonxnacniaI related development, on the parcels illustrated for future development, an application to amend the Official Plan would be required. CIRCULATED AGENCIES 3.1 To date, comments remain outstanding from seven (7) of the circulated agencies: Newcastle Public Works Department, Newcastle Community Services Department; Regional Public Works Department; Ministry of Natural Resources; Ontario Hydro; and c.P. Rail. 3.2 The agencies which have commented to date generally have had no objection to the proposed rezoning and plan of subdivision. Regional Planning Staff, in their comments, have noted that the proposal appears to comply with the Official Plan policies, however, they were not able, at this time' to comment on the implications of servicing for this proposal. 3.3 Ministry of Transportation Staff have noted some oouoecno with the proposed location of Street 'Av onto Highway 0o. 3. Due to limited � visibility it will be required to be relocated to the extreme west limits of the property. Also noted in the comments is the minimum residential setback of 7.5m to Highway 0o. 2. As well, the applicant will be required to fulfill some conditions; two of which are Storm- Water Management and Drainage Report, and o Traffic Report both satisfactory to Ministry Staff. � 3.4 Staff note that numerous residents have reviewed the proposal in the Hampton office. The gciuoiDIe concern is the affect on existing residents abutting the proposal, as well as the location of the Neighbourhood park. 4. STAFF COMMENTS 4.1 Comments received to date have not raised any objection to the proposal. As well, Staff note the application appears to be in compliance with the policies of both the Durham Regional Official Plan and the Town of Newcastle Official Plan. 1 ON REPORT 0O. : PD-3I4-88 PAGE 4 _______________________________________________________________________________ 5. RECOMMENDATION As the purpose of this report is for the Public Meeting as required under the Planning Act and in consideration of the number of comments which remain outstanding and the number of concerns expressed by area residents, Staff are not presently in a position to make final recommendation on said application. Therefore, it is recommended that � � at such time as all the outstanding comments are received and the Plan of Subdivision is ready to be finalized, Staff will report back to Committee and Council with o recommendation on said application.
