STOOPS AND G. GERRITS PART LOT 24, CONCESSION 3, FORMER TWP. OF DARLINGTON OUR FILES: DEV 87-96 AND OPA 88-24/D RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD-216-88 be received; and 2. THAT the application to amend the Durham Regional Official Plan submitted by Mr. J. Stoop and Mr. G. Gerrits to permit two (2) non-farm residential lots be approved as infilling within a rural Residential Cluster to be identified in the implementing Zoning By-law; and 3. THAT the rezoning application be approved and the implementing by-law be forwarded to Council for adoption at such time as the Official Plan Amendment application is approved by the Region; and 4. THAT the applicants and the Region of Durham Planning Department be so advised. 1. BACKGROUND 1.1 On July 18, 1988, Committee considered Staff Report PD-153-88 in consideration of an application to amend the "Major Open Space" designation of the Durham Regional Official Plan to permit the creation of two (2) non-farm residential lots. . . .2 REPORT Nn P 216- 88 PAGE 2 ------------------------------------------------------------------------------- 1.2 Committee had resoloved to refer the application back to Staff for further discussion with the applicants. In addition, Staff was directed to review the Node and Cluster policies, and in accordance with this direction, Report PD-174-88 was forwarded to Committee on September 6, 1988 at which time, the Committee rescinded the Town's Rural Cluster policies and that the Region's criteria for identifying Nodes and Clusters be used until such time new policies are developed by Town Staff. 2. COMMENTS 2.1 Accordingly, Staff have reviewed the application with regards to the criteria used in the Regional Official Plan. The criteria are that a Cluster or Node must be definable as a separate entity so as not to be considered as strip or scattered development, the existing group of dwellings must be on relatively small lots and new Clusters may not be located on Provincial Highways or Type "All Arterial Roads. Finally, the development within the Cluster must be compatible with surrounding uses and conforms with the Agriculture Code of Practice. 2.2 Staff have reviewed the criteria with respect to the characteristics of the area and is satisfied that there is an identifiable Cluster in the area as per the requirements in the Durham Regional official Plan. In that regard, Staff have prepared a schedule indicating the area to be defined as a separate entity. (see attached sketch) 3. RECOMMENDATION Given the above, Staff is recommending that the Official Plan Amendment application be approved and the implementing zoning by-law will be forwarded to Council for approval once the Official Plan amendment receives approval from the Region.
