S(JEUECT: EXTENSION OF DRAFT APPROVAL

RECOMMENDATION$:
it is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1. THAT Report PD-222-88 be received; and
2. THAT Council adopt the .following resolution:
"THAT Council of the Town of Newcastle hereby advises the Minister of
Municipal Affairs that the Town of Newcastle has no objections to the
extension of draft approval for Subdivision 18T-76021 for a further one
(1) year period to December 30, 1989"; and
3. THAT the request in Recommendation No. 2 be forwarded to the Ministry of
Municipal Affairs and the Owner be so advised.
1. BACKGROUND:
1.1 A copy of the attached letter was received by the Planning and Development
Department on October 11, 1988. The letter, addressed to Mr. Palter, noted
that draft approval with respect to Plan 18T-76021 as revised will lapse on
December 30, 1988 purusant to the Planning Act unless an extension is

granted prior to the lapsing date. The Ministry is now considering to
grant such an extension. Accordingly, Ministry Staff request
confirmation of the status of the PIou of Subdivision as previously
recommended for approval by the Town of 0ewooatIa.
1.2 Staff would note for the Committee's information that the conditions
of draft approval as previously issued are ouuoioteut with Town Policy
in the review of Plans of Subdivision.
1.3 In consideration of the above-noted comments, Staff would have no
objections to the extension of draft plan approval for a further one
(l) year period to December 30v 1989 with respect to Plan 18T-76021.

Dear Mr . Palter :
Subject : Lapsing of Draft Approval
Subdivision No. 18T-76021
Municipality : Town of Newcastle
Draft approval of the above subdivision will lapse
on December 30, 1988. If you are interested in
pursuing final approval please send us a request
for extension of draft approval stating reasons, in
advance of the lapsing date, with copies to the
local area municipality and regional planning
departments. In order to identify any potential
problems I recommend that you also discuss the
extension with the local planning department .
By a copy of this letter we are asking both local
area and regional municipalities to advise us of
their position on the extension request. A copy of
this letter is also being sent to the Ministry of
the Environment, the Ganaraska Region Conservation
Authority and the Ministry of Natural Resources, so
that they can advise us if any new concerns have
arisen since the plan was originally .reviewed by
them, back in 1980.
Tf we do not hear from them we will assume they
hpva no objections. If there are any concerns w-ith
the requested extension we will contact you in
advance of the lapsing date.

Please remember that once draft approval has
lapsed , it cannot be reinstated and a new
appl � cotion will have to be submitted to the Region
of Durham.
