By-Law # MEETING: General Purpose and Administration Committee DATE: Monday, October 31, 1988 REPORT #: PD-223-88 FILE #: - PLN 30.1 SUBJECT: MODIFICATIONS TO THE TOWN'S STANDARD SUBDIVISION AGREEMENT AND SITE PLAN AGREEMENT PLN 30.1 RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD-223-88 be received; and 2. THAT the Director of Planning and Development, and the Director of Public Works, be authorized to make the necessary modifications to the Town's Standard Subdivision Agreement and Site Plan Agreement and to implement all modifications forthwith. 1. BACKGROUND: The Director of Planning and Development and the Director of Public Works have recently undertook a comprehensive review of the Town's standard Subdivision/Site Plan Agreements with a review to improve the said document to achieve the following objectives: a) to eliminate areas of ambiguity in interpretation b) to elaborate landscaping, fencing, architectural control and park development requirements c) to ensure the Town will have sufficient financial protection in the course of administration and enforcement of the agreement d) to update the agreement to reflect current Council policies. . . .2 REPORT NO.: PD-223-88 PAGE 2 ------------------------------------------------------------------------------- 2. DISCUSSION OF PROPOSED CHANGES TO AGREEMENT Several major changes are introduced and are discussed as follows: 2.1 Architectural Control New provision with respect to Architectural Control will be added. Prior to the issuance of a building permit, we will require the developer/builder to retain an architect to provide the Town with: a) An Architectural Control Plan to achieve the objectives of provision of a variety of housing style, harmony in colour of external materials, visual variety, streetscape treatment, external building materials etc. b) A certification from the architect that the aforementioned objectives are accomplished. 2.2 Landscaping A Landscaping Plan will be a standard requirement required to be submitted for approval by the Town prior to the execution of the Subdivision Agreement. Revised requirements include: a) all areas surrounding the dwelling must be sodded within one year of occupancy of the dwelling; b) tree planting to be provided at the ratio of one tree per lot; c) tree must be a minimum of 3.5 metres in height and 6 centimetres in caliper and must be planted within two (2) years of occupancy of the dwelling units. 2.3 Fencing Provision for fencing are now detailed as follows: a) Fencing is required at all rear yard and site yard backing on roadway, along walkway, park, open space, and between a residential use and other uses. 3 1l/ <u�' REPORT 00. ; PD-223-88 PAGE 3 _______________________________________________________________________________ b) Fences must be minimum height of 1.8 metres. o) Type, owlnc' material and design of fences must be detailed in Landscaping Plan. d) Cbaiuliuked fence is not permitted except along walkway. e) Where wood fence is proposed, only pressure-treated wood or better quality will be accepted. 2.4 PERFORMANCE GUARANTEE / In order to euaoce the developer/builder would comply with the IaudonmDiug, fencing, and parkland development requirements and cause these requirements to be installed expeditiously, Performance Guarantee in the form of a Letter of Credit will be required and the Town will have the authority to draw on the Letter of Credit to install these works if the developer/ builder are delinquent. 2.5 In addition to the foregoing oboogeo, there are numerous other housekeeping changes made to the Agreement. Some of the more � significant changes ace: a) Reduction of subdivision plan, landscaping plan, and tree � preservation plan (it applicable) as separate schedules in � Agreement; b) elaboration on maintenance guarantee requirements; o) allowing up to ten percent (lO%) of subdivision for model home purposes; d) detail criteria for preparation of Park Site Master Plan; e) staging of nuuatcoctiou required for large subdivisions to ensure minimal disruption to built-up area by onuatcootiou traffic; f) erection of "unassumed road" sign prior to construction; g) compliance with Ontario Building Code and Ontario Fire Code with | respect to access, storage of combustible materials, open burning etc. ^ ^ ,4 REPORT K0. : PD-223-88 PAGE 4 _______________________________________________________________________________ 3. CONCLUSION 3.1 The proposed changes pertaining to fire regulation and pack development have been discussed with the Fire Chief and the Director of Community Services who nououc with the recommended changes. 3.2 Staff are of the opinion that the above-noted changes are long overdue and are necessary. Doe to the complexity of the agreement, it would not be advisable to have Committee and Council to approve every little obmogea. As a result, it is recommended that the Director of DIauoiug ' and Development and the Director of Public Works be authorized to make all necessary changes and to implement them forthwith. 3.3 A copy of the revised standard subdivision agreement and site plan agreement will be finalized immediately upon Committee and Council approval of the recommendations contained herein and could be made available to Members of Council for their perusal.
