SUBJECT: REQUEST FOR ISSUANCE OF FOUNDATION PERMIT
CROTHERS LIMITED
FILE: PLN 7.2.1
RECOMMENDATIONS:
It is respectfully recommended to Council the following:
1. THAT Report PD-228-88 be received; and
2. THAT Mr. Rick Gay be advised that the Town is prepared to issue a Foundation
Permit for the proposed building of equipment sales and service shop by
Crothers Limited on Courtice Court provided he deposits with the Town:
a) a Letter of Credit of $50,000. ; and
b) a Letter of Undertaking that, prior to the issuance of a full building
permit by the Town, the Owner warrants to:
i) submit an Engineering Report based on test drilling to certify
that there is sufficient potable water to service the proposed
industrial operation as well as for fire protection purposes and
further, that the soil condition is suitable for sub-surface
sewage disposal acceptable by the Durham Region Health Department;
ii) enter into a Site Plan Agreement with the Town to include, among
other matters, a Letter of Credit as Performance Guarantee to
cover all landscaping works and other works as required by the
Public Works Department. It is understood that the $50,000. j
Letter of Credit will be adjusted based on estimated cost of these
works.

l. BACKGROUND
By letter dated October 14, 1988" Mr. Diob Gay, on behalf of Ccotbero
Limited, requested the Town to issue him a Foundation Permit for an
industrial building for equipment sales and services on Coortioe
Court, within the Couctine Road Industrial Park.
2. EXISTING POLICIES
2.1 Pocaoaut to 8y-law 79-151 (Site Plan approval) , no person shall
,
construct or place any structure or building on land without first
aeoociug site plan approval from the Town.
3.3 In view of the foregoing, the Director of Planning and Development is
not in a position to issue any Foundation Permit unless so directed by
Council.

3. COMMENTS
3.1 Application for site plan approval was made by Mr. Gay on September
13, 1988. The application was subsequently circulated to various
ogauoiea for onomneuta and, as of writing of this report, comments from
(
Public Works Department and Regional Health Department are still
outstanding. It is also noted that the applicant has yet to submit an
Engineering Report to demonstrate that the soil is suitable for septic
purposes and that there is sufficient water supply for the industrial
operation and fire pocLectiou purpose.
3.2 Notwithstanding the outstanding items yet to be dealt with prior to
entering into o Site Plan Agreement, Staff reviewed the request from
Mc. Gay and fully appreciate his position and, are of the opinion that
his request for a Foundation Permit merits consideration.

3.3 It has been the policy of Council that priority be given to industrial
and commercial development applications and Staff feel that this is n
case where Council could exercise some flexibility and direct Staff to
issue him the Foundation Permit.
3.4 However, in no doing, the Town moot ensure its interests and
requirements, financial and otherwise, are protected. As a result,
the recommendations contained herein are provided to Council for its
consideration.

Re: Crothers Equipment Limited Project
Dear Sir:
As per our conversation, we are requesting a foundation permit for
Crothers Equipment Project before the Site Plan Agreement is signed.
We fully agree not to proceed beyond the foundation portion of the
project until the site plan agreement is signed and full permit is
issued.
Please advise us of any conditions you may require. Thank you.
