THAT Report PD-231-88 be received; and 2. THAT the application to amend the Town of Newcastle Comprehensive Zoning By-law 84-63, as amended, submitted by Syvan Development Limited, be approved, permitting the development of one (1) lot for two linked dwellings; and 3. THAT the By-law attached be approved; and 4. THAT a copy of Council's decision be forwarded to the applicant. 1. BACKGROUND it 1.1 On July 5, 1988, an application was received by Syvan Developments Limited to rezone a 641.16 square metres (6901.6 sq. ft.) parcel of land in Lot 29, Concession 1, Clarke, from "Urban Residential Type Two (R 2)" to "Urban Residential Type One (R 1)" to permit the development of--linked--lot_-containing--two -dwelling-units.-_ . . .2 REPORT 0D. : PD-231-88 PAGE 2 _______________________________________________________________________________ 1.2 The subject parcel is pact of Lot 41 and the wbokof Lot 42 on registered Plan 1Oy0-810. Due to grading difficulty, the applicant proposed to re-adjust the lot lines between Lots 39 to 42 au that the original four (4) single family lots will be reduced to three (3) Iota. The new Lot 41 (see zoning schedule) is proposed for linked dwellings and beooe" this application is to amend the zoning by-law. 1.3 Staff would note for the Committee's information that, Ducooaut to Council's resolution of July 26, 1982 and the requirement of the Planning Act' the appropriate oigoage acknowledging the application was installed on the subject lands, and aoccooudiog property owners were advised of the proposal. 2. OFFICIAL PLAN CONFORMITY 3.1 Within both the Durham Regional Official Plaqo and the Town of Newcastle official Plan (Newcastle Village Dcbmo Area) the subject property is designated "Residential". The proposed zoning amendment would not have any impact on the density as it maintains the number of units previously approved. 3^ AGENCY COMMENTS / 3.1 To date written comments remain outstanding from two (2) of the circulated agencies, Regional Public Works Department and Regional Planning Department. However, verbal comments have noted no comment from either of these agencies subject to the applicant paying necessary levies to the Region. 3.2 All the other circulated agencies noted no objection to said application, including the Town of Newcastle Public Works Department, which commented that services have been stubbed to olImv for � / development as proposed by the application. ^ ^ ^3 REPORT NO. : PD-231-88 PAGE 3 3.3 As of the writing of this report no enquiry has been made from adjacent property owners. 4. STAFF COMMENTS 4.1 All comments received to date have been positive, not raising any objections to the proposed amendment. Staff notes the application is in compliance with policies of both the Durham Regional Official Plan and the Town of Newcastle Official Plan. Staff further note the proposed zoning amendment maintains the general intent of the Draft approval allowing a total of 42 dwellings approved for the entire subdivision. 5. CONCLUSION In consideration of the above comments, Staff would recommend approval of the said amendment since it maintains the intent of draft approval and the link lots will remain of a similar size and nature to the i surrounding approved lots. WHEREAS the Council of the Corporation of the Town of Newcastle deems it advisable to amend By-law 84-63, as amended, of the Corporation of the Town of Newcastle. NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the Town of Newcastle enacts as follows: 1. Schedule 115" to By-law 84-63, as amended, is hereby further amended by changing the zone designation from "Urban Residential Type Two (R2)" Zone to "Urban Residential Type One (R1)" as shown on the attached Schedule "X" hereto. 2. Schedule "X" attached hereto shall form part of this By-law. 3. This By-law shall come into 'effect on the date of passing hereof, subject to the provisions of Section 34 of the Planning Act.
