HomeMy WebLinkAboutPD-242-88 DN: 242-88 _ TOWN OF NEWCASTLE REPORT File # : Res. # By-Law # MEETING: General Purpose and Administration Committee DATE: Monday, November 21, 1988 REPORT #: PD-242-88 FILE #: DEV 88-93 & OPA 88-80/N SUB-JECT: APPLICATION FOR REZONING AND OFFICIAL PLAN AMENDMENT APPLICANT: COWAN PONTIAC BUICK LIMITED PART LOT 11, CONCESSION 1, FORMER TOWN OF BOWMANVILLE FILES: DEV 88-93 AND OPA 88-80/N RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: I 1. THAT Report PD-242-88 be received; and 2. THAT the applications for Official Plan Amendment - File: OPA 88-80/N and Zoning By-law Amendment File: DEV 88-93, submitted by Cowan Pontiac Buick Limited to permit the creation of an employee parking lot, be referred back to Staff for a subsequent Report pending receipt of the outstanding comments; and 3. THAT the applicant be so advised. 1. BACKGROUND: 1.1 On September 1, 1988► the Town of Newcastle Planning and Development Department received an application for rezoning from Cowan Pontiac Buick Limited to amend By-law 84-63, as amended. Subsequently, on September 6, 1988, the Town was advised by the Regional Planning Department of an application to amend the Town of Newcastle Official Plan. The subject applications would seek to amend the existing "Residential" designation/ zoning to develop a 1028 sq.m. site into a 33 space parking lot to be used by the employees of Cowan Pontiac Buick. . . .2 REPORT N0. : PD-242-88 PAGE 2 _______________________________________________________________________________ 1,2 The subject lands are located to the rear of the existing site of Cowan Pontiac Buick Limited, also known as 39/41 Church Street in BovxnauvilIe. The subject lands currently support a semi-detached dwelling and two accessory buildings. These buildings will be demolished to permit the parking lot which will initially be oocfuoed with limestone drips and ultimately resurfaced with asphalt. 2. 8DRROOD0I0Q LAND D8E8; The lands to the north, east and west of the subject lands are � primarily residential uses, noting that this area is the more mature area of Bovmauvilla" judging by the age of the homes. The lands to the south are those lands owned by the applicant where Cowan Pontiac Buick Limited is situated. Staff would note that this commercial establishment fronts on Highway 0o. 3, and the lands to the east, west and south are used for commercial uses. 3. PUBLIC NOTICE: Staff would note for the Committee's information that, pursuant to Council's resolution of July 26, 1982 and the requirements of the ( PImooiog Act, the appropriate aigmage acknowledging the application was installed on the subject lands. 4. CIRCULATION: 4.1 In accordance with departmental procedures, the application was circulated to obtain comments from other departments and agencies. Staff would note the following departments/agencies, in providing comments, offered no objection to the applications as tiled: - Central Lake Ontario Conservation Authority - Northumberland & Newcastle Board of Education REPORT 00. ; PD-242-88 PACE 3 ------------------------------------------------------------------------------- 4.2 The Town of Newcastle Public Works Department offered no objection to the amendments in principle, however, requested that the applicant enter into a Standard Site Plan Agreement with the Town. 4.3 Agencies that have yet to provide comments on the proposed applications are: - Ministry of the Environment - Regional Public Works Department - Regional DIauuiug Department - Separate School Board � 5. STAFF COMMENTS: 5.1 Staff have reviewed this application and have noted that these lands are located within the Main Central Area of the BovmmoviIle Urban Area as noted in the Town of Newcastle official Plan. The lands are currently designated as "Low Density Residential" by the Plan. 5.2 Staff have received a number of Letters of Objection to the proposal, noting that the resident's basic oounecu is the intrusion of commercial uses in a primarily residential area, impact on property ( values, and the dangers incurred by ocbonI children when the buildings will be demolished. 5.3 This Report is prepared for the purpose of facilitating a Public Meeting in accordance with the Planning Act requirements. 0uoe all outstanding comments have been received, Staff will be in a position to formulate a recommendation and report back to Committee with respect to these applications. . . .4 � REPORT NO. : �D-342 88 , _ PAGE 4 _______________________________________________________________________________ Respectfully submitted, Recommended for presentation to the Committee Jo --- ------------- Franklin Wu/ M.C.I.P.
