HomeMy WebLinkAboutPD-248-88 DN: 248-88 � TOWN OF NEWCASTLE J t REPORT File Res. # By-Law # MEETING: General Purpose and Administration Committee DATE: Monday November 21, 1988 REPORT #: PD-248-88 FILE #: 18T-81008 SUBJECT: EXTENSION OF DRAFT APPROVAL 481857 ONTARIO LIMITED (FORMERLY DONARUS MANAGEMENT GROUP) PART LOT 29, CONCESSION 2, NEWCASTLE VILLAGE FILE NO. 18T-81008 RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD-248-88 be received; and 2. THAT the Region of Durham be advised that the Town of Newcastle has no I objections to the extension of draft approval for Plan of Subdivision 18T-81008 for a further one year period to November 30, 1989. i 1. BACKGROUND. 1.1 B correspondence dated October 19 1988 Staff was advised that draft Y p , , i approval for plan 18T-81008 would lapse on November 30. 1988 pursuant to the Planning Act, unless an extension was granted prior to the lapsing date. The Region is presently considering the request for such an extension and as such have asked for confirmation of the status of the Plan of Subdivision by the Town. i 2. LOCATION. 2.1 The subject property is located within part of Lot 29, Concession 2, former Village of Newcastle, on the north side of Highway Number 2, east of and I . . .2 REPORT 0O. : PD-348-88 PAGE 2 _______________________________________________________________________________ � having access onto Old Kingston Road. Staff would note the subject property is within the urban area boundary of Newcastle Village. 3. STAFF COMMENTS 3.1 At the General Purpose and Administration Committee meeting of December 7th. , 1987, staff report PD-302-87 was submitted for Committees information. This report nckowledged the following: i) that a previous request for extension of draft approval (PD-331-87) was considered by Committee and Council. � ii) a ceaulotiuu was endorsed to the effect that Report PD-221-87 be received and that the Region be advised that the Town does not support the extension of draft approval. iii)Begioual Planning 3tutf' in consideration of the applicant's request for a draft extension provided Report No. 87-204 for consideration of Regional Planning Committee at their regular scheduled meeting of November lO, 1987. It is noted for the Committee's information that the recommendation contained within Report 87-204 noted as follows: ( l. THAT staff be directed to extend draft approval of subdivision 18T-81008 and to amend the conditions of draft approval by adding a condition requiring the Owner to carry out any necessary road improvements to the intersection of old Kingston Road and Highway No. 2 to the satisfaction of the Town of Newcastle and the Ministry of Transportation; and 2. THAT the Owner, the Town of Newcastle and the Ministry of Transportation be advised of Council's decision." Regional Council, at their subsequent meeting of November 17, 1987 endorsed the above recommendation. Sernas and Associates, on behalf of the owner, have indicated that they are diligently working towards the resolution of the outstanding items pertaining to the proposed development. This would include the acquiring of the necessary sanitary sewer and storm sewer easements, as well as the necessary approvals for the temporary access onto Old Kingston Road. 3.3 As confirmed by the petition submitted by the area residents, the proposal to close Old Kingston Road at the most easterly limit of the temporary road access to the subdivision is not acceptable. To that end, discussions have been undertaken with the Ministry of Transportation, G. M. Sernas and Associates and Town Staff to co-ordinate the proposed realignment of the Old Kingston Road intersection with the reconstruction of Highway No. 2 and construction of the "Temporary access road". 3.4 In as much as the previous extension to draft approval was not appealed and the amended conditions required that the Owner is to carry out any necessary road improvements to the intersection of old Kingston Road and Highway No. 2 to the satisfaction of the Town and the Ministry of Transportation, staff would concur that the extension to draft approval would allow the necessary time to address the conditions of draft approval within a development agreement and completion of same.
