(FORMERLY T. PERUN) PART LOT 31, CONCESSION 3, DARLINGTON FILE: 18T-77041 - OWNERSHIP TRANSFER TO KIDDICORP INVESTMENTS LTD. AND NALCO BUILDING COMPONENTS LIMITED RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD-256-88 be received; and 2. THAT the attached by-law authorizing execution of a Subdivision Agreement between Kiddicorp Investments Ltd. and Halco Building Components Limited and the Corporation of the Town of Newcastle be approved; and 3. THAT the Mayor and Clerk be authorized to execute the Subdivision Agreement between Kiddicorp Investments Ltd. and Halco Building Components Limited and the Town of Newcastle at such time as an agreement has been finalized to the satisfaction of the Director of Public Works and the Director of Planning. 1. BACKGROUND: 1.1 Staff would note for the Committee's information that the General Purpose and Administration Committee and Council at their meetings of December 1, 1986 and December 8, 1986 endorsed the following recommendation: 2 REPORT 00.: @D-256-88 PAGE 2 ~- _______________________________________________________________________________ "TB&T Report PQ-277-87 be received; and THAT the attached by-law authorizing execution of a Subdivision Agreement between Bazmax Development Limited and the Corporation of the Town of 0evmsaatLe be approved; and THAT the Mayor and Clerk be authorized to execute the Subdivision Agreement between 8mroxax Developments Limited and the Town of Newcastle at such time as an Agreement has been finalized to the satisfaction of the Director of Public Works and the Director of Planning." 1.2 Staff would acknowledge that in consideration of the above-noted resolution, the Subdivision Agreement between the Owner and the Town of Newcastle was forwarded to Baroax Developments Limited for the appropriate signatures and return for registration purposes. Staff would note that, a letter dated October 18, 1988 was received by Planning Staff advising that the properties in question had recently been purchased from Bazmex Development Limited by | KiddioorI? Investments Ltd. and 8aIoo Building Components Limited. 1.3 To that end, Staff vmooId note that the relevant changes oeoeaamzy to the Subdivision Agreement will be undertaken and furthermore require Committee and Council's approval of an Authorizing By-law in the name of I{iddioozg Investments Ltd. and Bnlou Building Cuopuueoto Limited. The Council of the Corporation of the Town of Newcastle hereby enacts as follows: 1. THAT the Mayor and Clerk are hereby authorized to execute on behalf of the Corporation of the Town of Newcastle, and seal with the Corporation's seal, an Agreement between Kiddicorp Investments Limited and Halco Building Components Limited and the said Corporation dated the day of 1988, in the form attached hereto as Schedule "X". 2. THAT the Mayor and Clerk are hereby authorized to accept, on behalf of the Town, the said conveyances of lands required pursuant to the aforesaid Agreement. 3. THAT Schedule "X" attached hereto forms part of this By-law.
