&JBJECT: SUMMARY REPORT ONTARIO MUNICIPAL BOARD HEARING
APPEAL BY FRANCESCO AND ELISABETTA LONGO FROM A DECISION OF THE
COMMITTEE OF ADJUSTMENT

RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1. THAT Report PD-259-88 be received for information.
1. BACKGROUND:
On Friday October 28, 1988 an Ontario Municipal Board hearing was held with
respect to an appeal by Francesco & Elisabetta Longo from the decision of the
Committee of Adjustment (A48/88) which granted Mr. & Mrs. Breen variances to
the side and rear yard setbacks. The subject property is in Part Lot 31,
Concesison 2, former Township of Darlington. (Nash Road West of Trulls Road)
The variance legallized an existing non-conforming situation and would allow
for future potential severance.
2. APPELLANT'S EVIDENCE:
Mr. and Mrs. Longo's main reason for objection, as outlined in their appeal to
the Ontario Municipal Board was that future development of their land, which is
directly to the south of the Breen's, could be land-locked. The Longo's did
not have legal representation and although present at the Hearing, did not
testify before the Board.

3. TOWN'S EVIDENCE:
Represented by Legal OouuoeIv ]ovmz Planning Staff gave evidence in support of
the variance, explaining that it is an existing situation, that the dwelling has
existed for a number of years, that no hardship would be brought onto
neighbouring properties by the granting of the variance and more importantly
that the proposed variance complies with the intent of both the Official Plan and
the Comprehensive Zoning By-law and the variance is considered minor in nature.
4. ONTARIO MUNICIPAL BOARD DECISION:
The Board, in a verbal decision, granted the variance as applied for.
