TOWN OF NEWCASTLE REPORT File # Res. # 77S-0 By-Law # MEETING: General Purpose and Administration Committee DATE: Monday, December 12, 1988 REPORT #: PD-266-88 FILE #: DEV 88-96 (X/REF: 18T-88071) SUBJECT: REZONING APPLICATION - MAROTTA HOLDINGS LIMITED PART LOT 9, CONCESSION 1, BOWMANVILLE OUR FILE: DEV 88-96 (X/REF: 18T-88071) RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD-266-88 be received; and 2. THAT the application to amend the Town of Newcastle Comprehensive Zoning By-law 84-63, as amended, submitted by G.M. Sernas and Associates on behalf of Marotta Holdings Limited, be referred back to Staff for further processing and the preparation of a subsequent report upon receipt of all outstanding comments: and 3. THAT a copy of Council's decision be forwarded to the applicant and the interested parties indicated hereto. 1. BACKGROUND 1.1 On September 7, 1988, the Town of Newcastle Planning and Development Department received an application to amend the Town of Newcastle Comprehensive Zoning By-law 84-63, as amended. The application was submitted by G.M. Sernas and Associates on behalf of Marotta Holdings Limited. The application would permit the development of a 7.82 ha (19.32 acre) parcel of land through Plan of Subdivision, north of Highway No. 2, west of Mearns Avenue and east of Vincent Massey Public School. REPORT NO.: PD-266-88 PAGE 2 ------------------------------------------------------------------------------- 1.2 The proposal consists of Ninety-six (96) street townhouses divided over two (2) courts and a block for commercial use having frontage on Highway #2. 1.3 Staff would note for the Committee's information that, pursuant to Council's resolution of July 26, 1982 and the requirements of the Planning Act, the appropriate signage acknowledging the application was installed on the subject lands and, surrounding property owners were advised of the proposal. 2. OFFICIAL PLAN CONFORMITY 2.1 The Main Central Area designation reflects the southern portion of the subject lands, and the application would appear to conform with this designation. The northern half falls within the "Residential" and "Hazard Lands" with "Environmentally Sensitive" component designation. Official Plan policies for lands within the "Hazard Land" designation with an "Environmentally Sensitive" designation requires that, where ever possible, Council retain, in a natural state, the lands identified as "Environmentally Sensitive". Although, development is permitted on said lands, the applicant is required to provide a study identifying the degree of "Environmentally Sensitive" lands involved. The application also appears to comply with the "Residential" designation. 2.2 In the Town of Newcastle Official Plan the subject property is designated "Main Central Area" - "Low Density Residential" with "Hazard Lands". The lands within the "Main Central Area', designation are further defined as "Medium and High Density Residential" on Schedule 7-2. The application would appear to comply with this designation. 3 REPORT NO. : PD-266-88 PAGE 3 ------------------------------------------------------------------------------- 2.3 The northern portion of the applicant's lands falls into the "Low Density Residential" and "Residential" with "Hazard Lands" designation. The Low Density designation states development shall not exceed 30 units per net residential hectare. This application would not appear to comply with this. Policies for the "Hazard Land" areas state that these lands shall be primarily for the preservation and conservation of the environment. Any development of these lands shall be subject to the regulations of the Conservation Authority and the Durham Regional official Plan. 2.4 Staff are of the opinion the northern portion of this plan does not conform to either the Durham Regional official Plan or the Town of Newcastle official Plan and that in keeping with policies of the Regional official Plan, the applicant should submit a study with regards to impact on the "Hazard Land" area. 3. CIRCULATED AGENCIES 3.1 To date comments remain outstanding from five (5) of the circulated agencies: Newcastle Community Services Department; Separate School - Board; Regional Planning Department; Regional Public Works Department; and the Ministry of the Environment. 3.2 The Town of Newcastle Public Works Department consider this application premature until such time that a Master Drainage Plan and Report for the watershed has been approved. Conservation Authority Staff and Ministry of Natural Resources Staff echoed similar concerns, in noting that Lots 40 to 42 and 59 to 96 extend well past the top of the bank and/or into the floodplain, and recommend that the "Environmental Protection (EP)11 zoning be maintained from the top of the bank to the Soper Creek tributary. 4 REPORT NO.: PD-266-88 PAGE 4 ------------------------------------------------------------------------------- 3.3 The Public School Board required the Plan be amended to indicate a student/pedestrian access through the subdivision to Vincent Massey Public School. The Fire Department noted that no Building Permits shall be issued until access routes are in compliance with Subsection 3.2.5.2(6) of the Ontario Building Code. 3.4 No other objections or comments were raised from the other commenting agencies. Staff note that area residents have made inquiries about the application. 4. STAFF COMMENTS 4.1 The application does not appear to comply with all provisions of the Town's official Plan and further the Public Works Department are not willing to provide detail comments until a Master Drainage Plan and Report is approved for the area. 4.2 In reviewing the Plan, Staff have identified several concerns which will need to be addressed prior to any recommendation being made: the encroachment of lots as outlined by Central Lake Ontario Conservation Authority and Ministry of Natural Resources into the "Hazard Lands" area; the extremely long cul-de-sac illustrated as Street "All which has no emergency access; and the potential for adjacent lands to develop in the context of this proposal. 5. RECOMMENDATIONS 5.1 As the purpose of this Report is for the Public Meeting as required under the Planning Act and in consideration of the comments and concerns outlined above, Staff are not presently in a position to make final recommendation on said application.
