HomeMy WebLinkAboutPD-272-88 DN: 272-88 TOWN OF NEWCASTLE REPORT File # Res By-Law # MEETING: General Purpose and Administration Committee DATE: Monday, December 12, 1988 REPORT #: PD-272-88— FILE #: DEV 8883, OP 2.2.2(4) SIRECT: APPLICATION TO AMEND COURTICE SOUTH NEIGHBOURHOOD DEVELOPMENT PLAN AND ZONING BY-LAW 84-63 COURTICE ANIMAL CARE PART LOT 29, CONCESSION 21 FORMER TOWNSHIP OF DARLINGTON RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD-272-88 be received; and 2. THAT the applications to amend the Courtice South Neighbourhood Development Plan and By-law 84-63, submitted by Lennis Trotter Architect on behalf of Courtice Animal Care to permit a Veterninary Clinic be referred back to Staff for a subsequent Staff Report pending receipt of the required Engineering Study; and 3. THAT the applicant and applicant's agent be so advised. 1. BACKGROUND: 1.1 On July 26, 1988 the Town of Newcastle Planning and Development Department received applications submitted by Lennis Trotter on behalf of Courtice Animal care Limited to amend the Courtice South Neighbourhood Development Plan and the Town of Newcastle Zoning By-law 84-63. 2 po REPORT NO. : PD-272-88 PAGE 2 ------------------------------------------------------------------------------- 1.2 The subject applications would seek to permit the rennovation of a 95 square metre dwelling in order to allow a Veterinary Clinic on a 1,997.16 square metre parcel currently designated as "Special Purpose Commercial" in the Town of Newcastle official Plan. The proposed use would be permitted within this designation. The lands would be designated as "Residential', in the Courtice South Neighbourhood Development Plan and zoned as "Holding - Urban Residential Type one ((H) (Rl)) . Staff would also note that the development would take place on private services. 2. LOCATION: 2.1 The subject property is located on the south side of Highway No. 2, west of Courtice Road (Regional Road 34) , being Part Lot 29, Concession 2, former Township of Darlington. 3. SURROUNDING LAND USES: 3.1 Lands to the north are Highway No. 2 corridor and Black Creek. To the east is Roy Nichols Motors, an auto dealership . Directly to the south is vacant open space and to the west are a number of residents, which are established on larger lots. 4. PUBLIC NOTICE: 4.1 Staff would note for the Committee's information that, pursuant to Council's resolution of July 26, 1982 and the requirements of the Planning Act, the appropriate signage acknowledging the application was installed on the subject lands. 5. CIRCULATION: 5.1 In accordance with departmental procedures, the application was circulated 3 REPORT NO.: PD-272-88 PAGE 3 ------------------------------------------------------------------------------- 5.1 to obtain comments from other departments and agencies. The following is a summary of the comments received thus far. 5.2 The Town of Newcastle Public Works Department offered no objection to the proposal, noting that the applicant/owner must enter into a Site Plan Agreement with the Town and must meet all the requirements financial and otherwise. 5.3 The Town of Newcastle Fire Department offered no objection, however noted that the proposed rennovations must comply to the appropriate sections of the Ontario Building Code and Ontario Fire Code. 5.4 The Central Lake Ontario Conservation Authority also offered no objection however pursuant to Ontario Regulation 161/80, permits would be required prior to any placement of fill or grading on this site. 5.5 The Regional Health Department will be unable to comment on the proposal until such time as a site plan of the sewage disposal system is received. 5.6 The Ministry of Transportation offered no objection to the proposed amendment however will restrict the existing entrance at the east limit of the property with no additional direct access to Highway No. 2. The Owner will be required to upgrade the existing entrance to commercial standards. In addition, permits for the sign will be required. 5.7 The Region of Durham Planning Department noted that since the development would proceed on private services, Section 8.3 of the Regional Official Plan would apply. The applicant would be required to submit an engineering report indicating that there is an adequate supply of potable water, adequate fire protection and suitable soil conditions for installation of a private waste disposal system. In addition, Section 8.3 requires that the private well and waste disposal system be installed to the satisfaction of the Regional Health Services Department. 4 . . \[v-/ REPORT K0.: PD-272-88 PAGE 4 ______ ___________________________________________ 6. COMMENTS: 6.1 Given the above-noted ouomeuta with respect to an Engineering Study and the requirements of the Health Department, Staff would reopeotfulll, recommend that the application be referred back to Staff for a subsequent report and recommendation.
