SUB-JECT: AMENDMENT TO BY-LAW #87-156, ENTITLED A BY-LAW TO
PROVIDE FOR THE LICENSING, REGULATING AND KEEPING OF DOGS
RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1. THAT Report PD-278-88 be received; and
2. THAT Report PD-225-88 be lifted from the table; and
3. THAT the attached By-law entitled a By-law to provide for the licensing,
regulating, and keeping of dogs, be passed; and
4. THAT a copy of the said by-law be published in all area newspapers.
1. BACKGROUND:
1.1 On October 31, 1988, Committee considered Report PD-225-88 and resolved to
table the report to allow the By-law Enforcement Officer to contact various
interested parties to discuss their concerns.

1.2 The By-law Enforcement Officer has subsequently discussed the proposed
By-law with the concerned parties. In addition, an advertisement has
been taken out in the area newspaper to inform the Town's residents of
the proposed By-law.
2. DETAILS OF BY-LAW
2.1 The attached By-law would prohibit any residents within the urban area
of Courtice, Bowmanville and Newcastle Village as designated in the
Town's official Plan from keeping more than three (3) dogs. It should
be noted that the previous proposed By-law suggested by Staff would
apply to the entire Town. Staff feel that, at this time, it would be
prudent to restrict the keeping of more than three (3) dogs in the
urban area where most of the complaints were originated. In addition,
the urban area generally consists of small lots and it would be
disruptive to the densely populated neighbourhood if excessive number
of dogs are allowed to be kept.
2.2 As for the hamlet and rural areas, we do not propose to have the
By-law applicable to these areas. We will monitor this situation and
if warranted, bring forth an amendment to this By-law for Council's
consideration at a later date.
2.3 In order not to create any immediate difficulty for those residents
who cannot comply with this By-law, there will be a period of three
(3) months and, those residents who are currently in contravention to
the By-law will have to comply on or before April 2, 1989.
2.4 In addition, the By-law also sets out the 1989 Licensing Fee for dogs.
There are no fee increases proposed.
2.5 Staff have also examined the various pound fees and felt that the
existing fees do not present sufficient deterrent to dog owners who
let their dogs run strayed.

The proposed By-law will increase the impounding fee from ¢20. to $30.
and for subsequent impounding, the fee for claiming would be $50. In
addition, the daily maintenance fee would be increased from ¢5. to
¢lO.

THE CORPORATION OF THE TOWN OF NEWCASTLE
By-law 88-
being a by-law to amend By-law 87-156
entitled a by-law to provide for the
licensing, regulating and keeping of dogs
WHEREAS the Council of the Corporation of the Town of Newcastle deems it advisable
to amend By-law 87-156 of the Corporation of the Town of Newcastle;
NOW UTMFOM the Council. of the Corporation of the Town of Newcastle hereby enacts
as follows:
1. That Section II of By-law 87-156 is hereby amended by the addition thereto
of the following:
(1) No person shall own or harbour and no household shall own or -
harbour more than three (3) dogs, within the Urban Areas of
Cburtioe, Bowmanville and Newcastle Village as designated by
Schedule "A" attached hereto and forming part of this by-law.
Those persons currently in contravention of this section will be
required to comply not later than April 2, 1989.
That Section II 2(a) of By-law 87-156 be deleted and replaced with the
following:
(a) The owner of a dog in the Town of Newcastle shall pay to the
Town of Newcastle, in each year, a license fee as follows:
(i) For a spayed or neutered dog, upon
presentation of proof of spaying or
neutering $ 10.00 each
(ii) For the first and second dog $ 20.00 each
(iii) For the third dog $ 30.00
(iv) For the fourth and each additional dog $ 50.00 each
* Note: Anyone wishing to license more than three (3) dogs is
advised to refer to Schedule 'A'.
3. That Section III (14) of By-law 87-156 be deleted and replaced with the
following:
(i) any owner claiming a dog which has been seized and impounded
shall pay to the Animal Control Officer the following pound
fees:
(a) $30.00 for the first impounding of a dog in a
calendar year;
(b) $50.00 for each subsequent mounding of that
dog in the same calendar year.
(ii) the amount of the maintenance fee payable under Section (i)
shall be $10.00 per day for each day that the dog remains
impounded including the day of seizure and impounding.
4. This by-law shall come into effect on the day of enactment.
By-law read a first and second time this 19th day of December 1988.
By-law read a third tine and finally passed this 19th day of December 1988.
