THAT Report PD-196-88 be received; and 2. THAT the Region of Durham be advised that the Town of Newcastle recommends approval of proposed draft Plan of Subdivision 18T-87021 dated revised June 22, 1988 as revised in red, and attached hereto, subject to the conditions contained in Attachment No. 1 hereto; and 3. THAT the application for Rezoning to implement the proposed Plan of Subdivision be approved and the necessary by-law amendment forwarded to Council, and that the removal of the "Holding (H)" symbol be deferred pending execution of a Subdivision Agreement; and 4. THAT the Mayor and Clerk be authorized, by by--law, to execute the Subdivision Agreement between The Quadrillium Corporation and the Corporation of the Town of Newcastle at such time as an Agreement has been finalized to the satisfaction of the Director of Public Works and the I Director of Planning and Development; and I 5. BACKGROUND: 1.1 On March 17, 1987, the Town of Newcastle Planning and Development Department was advised by the Region of Durham of an application for approval of a proposed Plan of Subdivision submitted by Touuey Planning, the agent for ONadzilliom Corporation. The application proposed to create 196 single detached dwellings, a park block, and a school block, on a 17.783 ha (43.94 acre) parcel of land in Part Lot lI, Couoeooiuo 3, BovmauviIle (south-west corner of Liberty Street and the 3rd Concession) . 1.3 8obaegoeutIy' on November 36, 1987" after several discussions with the applicant and his agent, a revised proposal was received by Town gIaouiog Staff. Further discussions concluded in a second revision being received on July 6, 1988. this is the Plan DceomutIy before Committee. Staff note the present plan proposes 206 single family dwelling units and a Block to be used for pact of a future convenience commercial development. 1.3 Staff note that an application for rezoning was submitted in March, 1987. The zoning amendment would be to permit the proposed residential development. In order to expedite the process, Staff undertook a joint circulation of the applications in accordance with departmental procedure. Docauaot to Council's resolution of July 26, 1982 and the requirements of the Planning Act, the appropriate oiguage acknowledging the application was installed on the subject lands and written notification was provided to all neighbouring properties within 150 metres (400 feet) of the subject site. 3. OFFICIAL PLAN CONFORMITY 2.1 Within both the Durham Region Official Plan and the Town of Newcastle official Plan (Bovanooville Major Urban Area) the subject lands are \ /V\c/ '^~ REPORT 00. : PD-196-88 PAGE 3 _______________________________________________________________________________ designated "Residential". The maximum density permitted within the 9oxmu of Newcastle Official Plan is 30 units per net residential hectare. The proposed density equals 15.94 units per hectare. Street "Ell of the proposed development complies with the Official Plan as a collector road. Staff note a school and neighbourhood Dark iodinated in the official Plan are being proposed on lands immediately to the west of said application. 3. PUBLIC MEETING 3.1 The Public Meeting was held on July 20' 1987 with proper notification of the meeting being given. Residents concerned raised issues of: road widening on Liberty Street; screening or fencing along Liberty Street; and sewers and water pressure. 4. COMMENTS FROM CIRCULATED AGENCIES &.I The following agencies and departments had noted no objection to the proposal: - Ministry of Natural Resources - Ministry of Agriculture and Food - Ministry of the Environment - Durham Regional BemItb Unit - Northumberland & Newcastle Board of Education - P.V.0.0.I<.C. Separate School Board - Ontario Hydro - Newcastle Hydro Electric Commission 4.2 Newcastle Public Works Department Public Works Staff have noted no objection to the said applications conditional upon the deletion of Street xFx as proposed and re-designing of the plan as the present design does not provide adequate separation between the local street and an arterial street; that a Master Drainage PIou for the entire watershed be prepared; that . . .4 REPORT 0O. : PD-196-88 PAGE 4 _______________________________________________________________________________ Newcastle Public Works tmeot (Coutvd) all easements be granted free and clear of any encumbrances; and that the other standard requirements regarding design criteria and Town Policy be satisfied financially and otherwise. 4.3 Newcastle Community Services Department Community Services Staff expressed no objection to the proposed application and have requested that as a condition of approval, the applicant be required to contribute to the Town a contribution equivalent to five percent (5%) cash-in-lieu of parkland. 4.4 Newcastle Fire Department Fire Department Staff have noted that the proposal is within the recognized five mile limit response area of Station #I. The Fire Department has noted a oouoecu in the ability to maintain the existing level of service, considering all of the major development that is occurring. 4.5 Central Lake Ontario Conservation Authority In Macob' 1988' Staff received nwmmeuLa from Authority Staff based on the revised plan. In these comments, C.L.0.C.A. is prepared to support draft approval of the plan, conditional upon the applicant satisfying various requirements; the most important of which includes a Master Drainage Plan acceptable to both the Town of Newcastle and Central Lake Ontario Conservation Authority. 4.6 Regional Public Works tm t Regional Works Staff noted the proposed subdivision is located outside the urban service area limit for BuvwnauvilIe. Therefore, the applicant is responsible for submitting a proposal to overcome servicing constraints in this area. STAFF COMMENTS 5.1 In reviewing the comments received from the various agencies, Staff note there were no objections to the proposal although there are oouoecua outstanding on the servicing of the site, the drainage of the watershed which includes the site, and some minor design changes. 5.2 Regional Planning Staff's comments on the rezoning indicated they would not support an amendment to the By-law until provision for services to the area have been arranged with the Region. Although, the servicing of these lands is not final, Regional Council recently approved a servicing agreement for the Oakacow lands (18T-82037) , immediately to the south of the subject application. The servicing proposal outlined in the Regional Report (88-160) means 3U0E II water supply can be provided, thereby permitting the subject development. The placing of a "Holding (H)II symbol provides the Region and the Town control on the proposal in terms of when development could take place. 5.3 Block 207 is proposed to be developed in conjunction with the abutting land for future convenience commercial use and is shown as a future development block. It is noted that a separate rezoning application for Block 207 has been scheduled for a Public Meeting on October 3" 1988. 5.4 Design revisions to the plan are indicated in red as obovmn in � Attachment #2. Doe to the inadequate separation between the local � street and the arterial road, the Dco@uaed Street "F1' has been eliminated and six (6) Iota will have direct aooeaa to Street "Ell leaving a Block to be developed in the future in conjunction with the | lands to the south. 5.5 Lot 206 is also placed on bold in order to allow the potential for a more intense use of the lands abutting to the north. However, by freezing Lot 206 it allows the potential for a second lot fronting Street "Ell. 5.6 During discussions with the 8arret'a (owners of the property bounded by Lots 193, 194, 305 and 206 and Liberty Street) , it was brought to Staff's attention that an easement, in their favour, is registered on pact of proposed Lot 193 for the gorDooea of a septic system. The applicant's agent has confirmed this to be the case. Staff therefore are of the opinion that this lot should not be allowed to be developed until such time as the issue of the easement has been satisfactorily addressed by the applicant. 5.7 Staff also note the irregular configuration of Lot 194 and recommend this lot not be permitted for development until such time as it is developed in conjunction with the 8acrett`a property and Lot 193. 5.8 The various design changes identified in Staff comments have been incorporated into the redline revisions of the Plan as well as covered in conditions of draft approval. 6. RECOMMENDATIONS In consideration of the above-noted agency and Staff comments, Staff recommend draft approval of the proposed subdivision as redline revised, conditional upon the attached conditions, and approval of the rezoning to allow the residential development. Staff, however, | recommend a "Holding (8)" symbol be placed on the rezoning until such time as a Subdivision Agreement has been executed. Respectfully submitted, Recommended for presentation to t�q. B{WMA0VZLL0, Ontario LIC 3K6 ATTACHMENT NO. 1 TO REPORT PD-196-88 TOWN OF NEWCASTLE CONDITIONS OF DRAFT APPROVAL SUBDIVISION APPLICATION 18T-87021 1. This approval shall apply to draft Plan of Subdivision 18T-87021 prepared by Tunney Planning, dated revised June 22, 1988, as revised in red on the attached plan illustrating 206 single family dwelling units. This approval does not apply to Lots 193, 194 and 206. 2. The developer shall enter into a Subdivision Agreement with the Town of Newcastle in respect of the subject plan which shall include, in addition to the Town's standard requirements, specific provisions with respect to the following Conditions 3 to 19, all inclusive. 3. That all works are completed in accordance with the Town of Newcastle's Design Criteria and Standard drawings. 4. That any easements required by the Town be granted free and clear of all encumbrances. 5. That the applicant be required to pay to the Corporation of the Town of Newcastle, 5% cash-in-lieu of parkland dedication. 6. That the utility distribution on the internal streets (Hydro, Bell, Cable TV, etc.) be installed underground and that all secondary services for the proposed lots be underground. 7. All of the other standard requirements re: Lot Grading, Schedules of Work, Performances Guarantees, Cost Estimates, etc., should be included in the Subdivision Agreement. 8. That the applicant shall submit a Landscaping Plan to the Director of Planning and Development for approval. Said Landscaping Plan shall, among other standard landscaping matters, address boulevard tree planting, landscaping treatment where service road abuts Liberty Street, screening between Block 207 and abutting residential use. 9. That a Master Drainage Plan and Report for this site and the entire watershed be prepared to the satisfaction of the Director of Public Works and Central Lake Ontario Conservation Authority, that outlines the proposed Major and Minor storm sewer systems. 10. That the applicant shall provide for the construction of a concrete sidewalk on Liberty Street. 11. That the applicant meet all the requirements of the Public Works Department, financial or otherwise. 12. That prior to the commencement of site preparation, including the rough grading of roads, the Owner shall obtain C.L.O.C.A. approval of an erosion and sedimentation control plan for the subject lands. 13. That the applicant meet all the requirements of the Durham Regional Public Works Department. 14. That Lots 193, 194 and 206 be shown as Blocks 209, 215 and 216 and that they be maintained and be developed in conjunction with the adjacent lands. 16. That no building permits for Lots 1, 18, 41, 42 and 110 shall be available until such time that the temporary turning circle is eliminated through extension of the urban road sections adjacent to same. 17. That a 0.3 metre reserve be placed on Lots 17 and 75 where they abut Street "E" and on Lot 111 where it abuts Street "B" . 18. That no building permits be issued until access routes meet Subsection 3.2.5.2(6) of the Ontario Building Code and until watermains and hydrants are fully serviced. 19. The subject By-law would permit the development of Two Hundred and Six (286) single family dwellings. DN: A/HR1 1 S 4 5� THE CORPORATION OF THE TOWN OF NEWCASTLE BY-LAW NUMBER 88- being a By-law to amend By-law 84-63, the Comprehensive Zoning By-law of the Corporation of the Town of Newcastle, WHEREAS the Council of the Corporation of the Town of Newcastle deems it f. advisable to amend By-law 84-63, as amended, of the Corporation of the Town '; of Newcastle. NOW THEREFORE BE IT RESOLVED THAT the .Council of the Corporation of the Town of Newcastle enacts as follows: #, 1. Schedule "3" to By-law 84-63, as amended, is hereby further amended by changing the zone designation from "Agricultural (A)" to "Holding - Urban Residential Type One ((H)R1)" Zone as shown on the attached Schedule "X" hereto. f i � 2.
