SUDJECT: REZONING AND SITE PLAN APPLICATION

RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1. THAT Report PD-188-88 be received; and
2. THAT the rezoning and site plan application submitted by Doug Coggan,
Ontario Land Surveyor on behalf of Arnold Kerry to rezone a one (1) hectare
parcel to permit the construction of a farm implement dealership, be
approved and the necessary by-law forwarded to Council at such time as a
Site Plan Agreement has been executed; and
3. THAT the applicant and applicant's agent be so advised.
1. BACKGROUND:
1.1 On July 18, 1988 Committee considered Staff Report PD-157-88 in
consideration of an application to amend the Town of Newcastle Comprehensive
Zoning By-law 84-63, as amended. The By-law amendment, if approved, would
permit the development of a farm implement dealership, located in Part Lot
34, Concession 6, former Township of Clarke.

1.2 The application was referred bank to Staff in order to allow the
applicant to prepare o detailed site plan. In addition, Staff has not
yet received the outstanding comments for the agencies/departments.
2. DETAILS OF IR}P08&L
2.1 As noted in Report PD-I57-88, the proposal would develop one (l)
hectare of a larger 66.46 hectare parcel of land presently zoned
"Agricultural (A)n and "Agricultural Exception (&-l)». The proposed
building would be approximately 555.47 og.m. (6000 ag.ft.) , the area |
required for the sale and service of the machinery. The remainder of
the subject area will be paved and will allow for the placement of the
form machinery. Staff would note, however, that the detailed plans
for the execution of the site plan agreement has not been received to
date. Staff would require a site plan indicating area of display,
fencing or screening, and elevations of front, side and rear of the
proposed structure.
3. COMMENTS
3.1 As noted earlier, comments were outstanding from Town of Newcastle
Public Works Department, Regional Planning Department, Regional Works

Department, Ministry of Agriculture and Food and Ministry of the
Environment. Staff would note that these comments have now been
received and in addition the Ministry of Agriculture and Food and
Ministry of the Environment offered no objection to the application as
filed.
3.3 The Town of Newcastle Public Works Department offered no objection,
however' requested the applicant to enter into a Site Plan Agreement
with the Town, noting that the standard requirements such as Lot
Grading Plans, Performance Guarantees be included in the Agreement.
3.3 The Regional Planning Department noted that the proposal would conform
to Section 12.2.12 of the Durham Regional Official Plan. Section
12.2.12 would allow the development to take place provided the use is |

compatible with surrounding uses and provided the development is not
highly productive lands. In addition, the use moat be recognized
under a special zoning category.
3.4 The Regional Works Department offered no objection, noting that
mUuioiyoI services are not available therefore, the development is to
proceed on private services. The Works Department also noted that the
proposed anneoa moot comply with the standards detailed in the Durham
Entranceway Policy. The department also requested o 3.05 metre
widening on the total frontage of the subject lands, abutting Regional
Road 0o. 4 (Taunton Road) as a condition of approval.
4. STAFF COMMENTS:
4.1 Staff have reviewed the application and is of the opinion that the
proposal would comply with the policies in the Durham Regional
Official Plan. In that regard, Staff would note that the subject
lands are now used for agricultural purposes, however, given that only
one (l) hectare of a larger 66 hectare parcel will be used for the
development and in consideration of the Ministry of Agriculture and
Food's comments offering no objection. Staff is of the opinion that
the lands are not significantly productive in nature.

4.2 The surrounding loud uses are primarily agricultural uses. Given
this, Staff are of the opinion that the location of a farm implement
dealership would serve the needs of agricultural operations in the
vicinity.
5. RECOMMENDATION
In consideration of the above-noted comments, Staff would recommend
that the application be approved and the necessary by-law be forwarded
