RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1. THAT Report PD-181-88 be received for information.
1. BACKGROUND:
1.1 As members of Committee may recall, on June 6, 1988, Committee had before
them Report PD-127-88 recommending approval of a rezoning application. The
application would permit a veterinary clinic in a Neighbourhood Commercial
Plaza at the northwest corner of Highway No. 2 and Centrefield Drive in
Courtice, also known as WestCastle Plaza. Subsequently on June 13, 1988,
Council endorsed Committee's recommendation and approved the application.

1.2 Staff, in the initial review of the application had considered the
potential problems with respect to noise given that the surrounding
uses are primarily residential. Staff had recommended approval and had
resolved to amend the definition of veterinary clinic, by deleting the
clause which states that facilities be provided for the sheltering of
animals during the treatment period. Furthermore, Staff had resolved
to amend the existing development agreement between W.E. Roth
Construction and the Town, to state that the overnight stay of animal
may not be permitted and further, that the owner agree to provide
adequate sound insulation in the demising walls of the vet clinic.
1.3 At the meeting of July 18, 1988, Mr. Stephen Shine appeared before
Committee on behalf of Dr. G. Topolie, D.V.M. Mr. Shine requested the
By-law be amended or clarified to allow overnight boarding of animals
during treatment period. Subsequently, this matter was referred back
to the Planning Department for appropriate action.
2. APPEALS:
2.1 Staff would note for the Committee's information that the last date of
appeal for them to become final and binding was July 18, 1988. On July
15, 1988, the Clerk's Department received a written appeal by one of
the residents in the area. The appellant is basically concerned with
the noise, mainly dogs barking coming from the proposed veterinary
clinic.
3. COMMENTS:
Given that the applicants are not satisfied with by-law and agreement,
and given that an appeal of the By-law has been received, Staff is of
the opinion that this issue of overnight boarding of animals can be best
dealt with by the Ontario Municipal Board.
