By-Law # ' MEETING: General Purpose and Administration Committee DATE: Tuesday, September 6, 1988 REPORT #: PD-179-88 FILE #Z)EV 88-25 I SUBJECT: REZONING APPLICATION - FORD CANNING PART LOTS 29/30, CONCESSION 1, FORMER TOWNSHIP OF DARLINGTON OUR FILE: DEV 88-25 i RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD-179-88 be received; and 2. THAT the rezoning application submitted by Ford Canning to rezone a parcel, located in Part Lot 29/30, Concession 1, former Township of Darlington, to permit the construction of a Church and ancillary uses be approved and the necessary by-law be forwarded to Council at such time as a Site Plan Agreement has been executed; and 3. THAT the applicant be so advised. 1. BACKGROUND: 1.1 On Monday, May 16, 1988, Committee considered Staff Report PD-107-88 (copy attached) in consideration of an application to amend the Town of Newcastle Comprehensive Zoning By-law 84-63, as amended. The By-law amendment, if approved, would permit the development of a Church and ancillary uses such as an educational wing with classrooms, office space, recreational room (gymnasium) and a main sanctuary. I . . .2 REPORT NO. : PD-179-88 PAGE 2 1.2 The application was referred back to Staff in order to allow the applicant to discuss concerns with Ministry of Agriculture and Food and to allow Staff to review the comments from Regional Works Department with respect to access. In addition, Staff had received revised site plans, circulated same, and received outstanding comments from the agencies. 2. DETAILS OF PROPOSAL: 2.1 Staff have reviewed the revised site plan and have noted that the development of the proposal will take place in phases. Phase One will be the construction of a 465 square metre building with a seating capacity of 208. In addition, the preliminary site plan would indicate five classrooms, a nursery/preschool, office facilities, kitchenette and washroom facilities. The second phase, to be constructed at a later date, would include gymnasium and the necessary parking facilities. i 3. COMMENTS: 3.1 As noted earlier, a revised site plan was circulated to obtain any additional comments from outside agencies. 3.2 The Regional Health Department offered no objection, however requested that the area for a private sewage disposal system be increased to accommodate the development. 3.3 The Regional Works Department requests a 22 foot road widening on the total Bloor Street frontage of the subject lands in addition to a sufficient road I widening on the total Courtice Road frontage of the subject land so as to provide a street line being 60 feet from the centre line of the existing Courtice Road right-of-way. The Regional Works Department also requested the closure of the existing Bloor Street access. I . . .3 I I i REPORT NO. : PD-179-88 PAGE 3 3.4 As noted in PD-107-88, the Ministry of Agriculture and Food did not recommend approval of this proposal, based on the provisions of the Foodland Guidelines stating that institutional uses should be directed away from good agricultural land noting that the site is level Class 1 farmland. Staff would note that the Ministry has not changed their position since the revised plan has been circulated. 4. STAFF COMMENTS: 4.1 Staff have reviewed the application and have noted that Section 6.2.6 in the Durham Regional Plan pertaining to General Agricultural designation, allows the local Council to recognize in the restricted area zoning by-law, police stations, public parks and cultural facilities such as cultural centres, libraries, museums and places of worship in any area having first been satisfied that the proposed facility is compatible with its surroundings. This section further notes that such a facility should not restrict or conflict with predominant permitted land uses.
