THAT Report PD-177-88 be received; and 2. THAT rezoning application, submitted by Julius Kepple, be approved for one (1) additional lot only as per the attached schedule; and 3. THAT the attached amending By-law be passed; and 4. THAT the applicant be so advised. 1. BACKGROUND: 1.1 On June 13, 1988, the Planning Department received an application for rezoning submitted by Julius Kepple, to rezone a parcel of land in Part Lot 27, Concession 2, former Township of Darlington to permit the development of (2) two non-farm residential lots. . . .2 fo) REPORT NO. : PD-177-88 PAGE 2 ---^--------------------------------------------------------------------------- 3. OFFICIAL DIA0 CONFORMITY 2.1 The subject parcel is designated as "General Agricultural" in the Durham BagiouoI Official Plan. The Regional official Plan states that the predominant use of lands under this designation shall be for agricultural and farm-related uses. The Plan also states that the development of new non-farm residential oaea shall be discouraged within this designation ouleoo such development proceeds in the form of iufilIiug between existing residential dwellings and provided that such development is recognized as a Residential Node or Cluster in the local municipality's Zoning By-law. 3. ZONING BY-LAW CONFORMITY 3.1 The subject lauds are currently zoned "Agricultural" in the Town of Newcastle Comprehensive Zoning By-law 84-63 as amended. This zone does permit non-farm residential oaeo which predate the present by-law. However newly created lots by severance moot be recognized as a Node or Cluster in the By-law. 4. PUBLIC NOTICE 4.1 Staff would note for the Committee's information that pursuant to Council's resolution of July 26, 1983 and the requirements of the Planning &ot' the � appropriate olguage acknowledging the application was installed on the subject lands. 5. CIRCULATION: 5.1 In accordance with departmental procedures, the application was circulated to obtain comments from other departments and agencies. Staff would note the following departments/agencies in providing comments, offered no objections to the application as filed. - Town of Newcastle Fire Department - Ministry of Agriculture and Food - Region of Durham Works Department - Central Lake Ontario Conservation Authority REPORT 00. : PD-177-88 PAGE 3 ' 5.2 The Town of Newcastle Public Works Department offered no objection, however require the applicant's engineer to submit a lot grading plan/ to include the ditches fronting the property. 5.3 The Town of Newcastle Community Services Department offered no objection to the proposal, however requested the applicant Day 5% cash-in-lieu of parkland dedication. 5.4 The Durham Regional Health Department offered no objection provided that each lot be 30'000 ogoarm feet, therefore Lot #1 would have to be- increased in size. 5.5 The Durham Regional Planning Department offered no comment provided the proposal satisfies the criteria for Node and Clusters as denoted in Section I0.2.1.3 of the Durham Regional Plan. 6. COMMENTS 6.1 Staff have reviewed the application with regard to the criteria set out in the Durham Regional official Plan with respect to identification of 8oroI Clusters and is satisfied that the proposed development meets the criteria. 6.2 However, Staff noted that one of the proposed Iota does not comply to Zoning By-law provisions with respect to lot area, specifically Lot One, would have a lot area of 2'322.5 ogooza metres (25,000 square feet) and 30 metres of frontage. Lot Two, although complying with the by-law, would result in the retained land having only I6.76 metres (55 feet) of frontage (see attached) . 6.3 Staff would note for the Committee's information, that a xBocal Cluster (RC)II was recognized by Council in January 1986, 8y-law 86-3, 'oat south of the south lands. Given this and the fact that Lot l and the retained land do not have sufficient lot area and frontage respectively, it would appear that the creation of only one lot (Lot #2) can be considered as a minor extension to an existing or recognized cluster. WHEREAS the Council of the Corporation of the Town of Newcastle deems it advisable to amend By-law 84-63, as amended, of the Corporation of the Town of Newcastle. NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the Town of Newcastle enacts as follows: 1. Schedule 114" to By-law 84-63, as amended, is hereby further amended by changing the zone designation from "Agricultural (A)" to "Rural Cluster (RC)" as indicated on the attached Schedule "X" hereto. 2. Schedule "X" attached hereto shall form part of this By-law. 3. This By-law shall come into effect on the date of passing hereof, subject to the provisions of Section 35 of the Planning Act.
