SERNAS & ASSOCIATES (M. VELTRI & SONS) PART LOTS 29 & 30, BROKEN FRONT CONCESSION FORMER TKP. OF DARLINGTON OUR FILE: DEV 88-56 RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT and Report PD-1 2-88 be received;p 7 , i i 2. THAT the rezoning application submitted by G.M. Sernas and Associates on behalf of M. Veltri and Son Ltd. to rezone a .404 hectare parcel to permit the development of a fuel bar, convenience store and eating establishment be referred back to Staff for a subsequent report pending receipt of an Engineering Study and outstanding comments from the outside agencies and departments; and i 3. THAT the applicant and applicant's agent be so advised. 1. BACKGROUND: i i 1.1 On May 27, 1988, the Planning Department received an application from G.M. Sernas and Associates submitted on behalf of M. Veltri and Sons Limited, to amend By-law 84-63. . . .2 REPORT NO. : PD-172-88 PAGE 2 ------------------------------------------------------------------------------- 1.2 The subject application would seek to develop .404 hectares of an existing 10.3 hectare parcel of land to permit the development of a fuel bar, convenience store, in addition to those uses permitted in the "Light Industrial (Ml)" zone in Part Lot 29 & 30, Broken Front Concession, in the former Township of Darlington. 2. OFFICIAL PLAN CONFORMITY 2.1 The subject lands are designated as "Industrial" and "Hazard Lands" in the Durham Regional Official Plan. Section 8.3.3.3 and 8.4.2.1 would allow the proposed development as a permitted use provided the "Hazard Lands" are not encroached upon. 3. ZONING BY-LAW CONFORMITY 3.1 The subject lands are currently zoned as "Light Industrial (Ml) " within By-law 84-63, as amended. The proposed development is not permitted in said zone, however, could be recognized through the rezoning application. 4.0 PUBLIC NOTICE 4.1 Staff would note for the Committee's information that, pursuant to Council's resolution of July 26, 1982 and the requirements of the Planning Act, the appropriate signage acknowledging the application was installed on the subject lands. 5. CIRCULATION: I 5.1 In accordance with departmental procedures, the subject application was circulated to various agencies and departments to obtain comments. The following departments/agencies offered no objection to the proposal: - Ministry of Agriculture and Food . . .3 DBP0BT 0O. : PD-172-88 PAGE 3 ------------------------------------------------------------------------------- 5.3 Town of Newcastle Fire Department offered no objection, boweverr, noted that the applicant will be required to comply with all aspects of the Ontario Fire Code and the Ontario Building Code in addition to the Gasoline Handling Act and Code. 5.3 The Regional Health Department, noted more information is required in order to assess the proposal. The Department requires a site DIao indicating the proposed location of all structures, drilled wells and subsurface, sewage disposal system envelopes, including a 1000 replacement area of systems. In addition, the Department requires an � Engineered designed sewage disposal system and a soils report. 5.4 The Ministry of Transportation noted that the Highway 0n. 401 will eventually be widened to approximately ten (10) lands and although these lands are not affected by this future widening, the land to the south of this property will be impacted. In addition, the Ministry requested that anneaa to the lands be located beyond the Ministry's area of control. 5.5 Staff would uVta that onmm*uta are still outstanding from the following agencies: - Town of Newcastle Public Works Department ' - Central Lake Ontario Conservation Authority - Region of Durham Works Department - Ministry of the Environment - Ontario Hydro G^ COMMENTS: i 6.1 In addition to the above-noted comments, Staff have also received comments from the Regional Planning Department. The department noted that Sections 8.3.3.3 and 8.4.2.1 of the Durham Regional Official Plan would permit the proposed use provided that Local Council finds the | | proposed use to be compatible with surrounding laud uses. In addition, Section 8.4.3.3 requires that an Engineering Report pertaining to the servicing aspects of the site be submitted. The DIau also specifies that an appropriate setback from Highway 401 is necessary and that development incorporate high quality materials, design standards and landscaping. 6.2 With respect to access, the Region also noted that Regional Road 0o. 34 is designated as a Type »&`' Arterial road in the Regional official Plan, therefore limiting the anoeoo to Baseline Road. In addition, the Region has requested that the environmentally sensitive area be retained under the "Environmental Protection (EP)" zoning. . � 7. I008: In consideration of the comments and the comments still � outstanding from various departments/agencies, Staff would respectfully recommend that the application be referred back to Staff in order to prepare a subsequent report.
