RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:

1. THAT Report PD-165-88 be received; and
i
2. THAT the application to amend the Enniskillen Hamlet Plan, File: 3.3(6) j
submitted by Linda Sweet, to increase the maximum number of lots permitted
from "2" to 113" be approved and the attached amendment forwarded to Council;
and
3. THAT the Zoning By-law amendment be approved and also forwarded to Council
for approval; and
4. THAT the applicant and the applicant's agent be so advised; and

5. THAT the Region of Durham and the Ministry of Municipal Affairs be requested
to incorporate this proposed amendment in the consideration of approval of

the Hameet Policies of the Town of Newcastle Official Plan.

1. BACKGROUND
1.1 On September 8, 1987, Committee had before them Report PD-203-87, approving
Staff's recommendation to refer the applications to amend the Enniskillen
Hamlet Plan and Zoning By-law 84-63; back to Staff for the preparation of a
subsequent report pending receipt of the outstanding comments and an
Engineering Study. Subsequently, on September 14, 1987 Council endorsed the
recommendation through Resolution #C-732-87.
1.2 The rezoning application proposes to amend the existing zones of
"Agricultural (A)", "Residential Hamlet Exception (RH-3)" and
"Environmental Protection (EP)11 on a 2.4 hectare site to an appropriate
zone to permit the creation of three (3) residential lots. The amendment
to the Hamlet Plan would increase the number of lots from "2 to 113".
1.3 Staff would note that the initial proposal submitted indicated that the
three (3) proposed lots with individual access on Regional Road 3. The
Regional Works Department, did not support the proposal, noting inadequate
sight distance due to the grade to the immediate west. In consideration of
these comments, the applicant revised the proposal to have all three lots to
be served with one single access point through mutual right-of-way
arrangement. Subsequently, and in accordance with departmental procedures
the revised proposal was circulated to obtain further input from
agencies/departments.
2. OFFICIAL PLAN CONFORMITY
2.1 The subject property is located within the Hamlet development area of
Enniskillen. The Regional official Plan identifies Enniskillen as a Hamlet
for growth. The increase in the number of lots from 11211 to 11311 would be in
keeping with the intent of Official Plan policy.

3. D0WZNQ BY-LAW CONFORMITY
3.1 The subject lands are currently zoned "Agricultural (&)x, "Residential
Hamlet Exception (R8-3)n and "Environmental Protection (EP)11 within By-law
84-63. The proposed anu±ug obouge would recognize the creation of the three
(3) lots. Staff would note for the Committee's information that a portion
of one of the proposed lots is located within the "Environmental Protection
(EP)11 zone.
4. PUBLIC NOTICE
(
4.1 Pursuant to Council's resolution of July 26, 1982 and the requirements of
the Planning Act, the appropriate aiguage acknowledging the application was
installed on the subject lands.
5. COMMENTS
5.1 In accordance with departmental procedures, the revised proposal was
circulated to obtain oqnmeuta from the agencies and departments. The
following, offered no objection:
- Town of Newcastle Fire Department
' - Ministry of Agriculture and Food
- Ministry of Natural Beaoozneo
5.2 The Town of Newcastle Public Works offered no objection provided the
applicant prepare a Lot Grading Plan to the satisfaction of the Director of
Public Works.
5.3 The Town of Newcastle Community Services offered no objection, however 5%
cash-in-lieu of parkland dedication.
5.4 The Regional Planning Department noted that the increase in the number of
units permitted would be a minor increase in the residential density in the
subject area of Hamlet and would maintain the integrity of the maximum
allowance growth in the Hamlet.

5.5 The Regional Works Department noted that the new proposal siting only one
access, was acceptable. The single access to Regional Road 3 would be
approved in the approximate location shown on the submission and must be
designed in accordance with Regional Standards. Staff would note, that an
access is existing for the retained parcel.
5.6 As required under the policy of the official Plan, the applicant had
submitted a Hydrogeological Report to the Durham Regional Health Department
as well to Town's Planning Staff. The Report addressed the layout of the
septic tile beds, drilled wells and the location of the proposed dwellings,
all to the satisfaction of the Health Department.
5.7 Verbal comments from the Central Lake Ontario Conservation Authority,
indicated it has no objection to the proposal. The Authority noted a low
lying swale run diagonally toward the south-east through two of the three
lots. The swale contains water only during the spring runoff and remains
dry for the balance of the year. The Central Lake Ontario Conservation
Authority has no objection if this small swale area is zoned for residential
purpose.
6. CONCLUSION
6.1 Staff would offer no objection to the proposal noting that the addition of
one lot in Enniskillen would be in keeping with the integrity and the
intent of the Hamlet Plan, and that it satisfies the requirements of all
agencies.
6.2 Staff would note for the Committee's information that Section 9 - Hamlets of
the Town of Newcastle official Plan which has been deferred by the Ministry
pending further modifications. The modifications include housekeeping
changes to map schedules for the Hamlets and the general Hamlet policies.
Accordingly, it is also recommended that the Ministry and Region
incorporate this amendment into the new Hamlet Policies before final
approval.

BY-LAW NUMBER 88-
being a By-law to amend By-law 84-63, the Comprehensive Zoning By-law of the
Corporation of the Town of Newcastle.
WHEREAS the Council of the corporation of the Town of Newcastle deems it advisable
to amend By-law 84-63, as amended, of the corporation of the Town of Newcastle.
NOW THEREFORE BE IT RESOLVED THAT the Council of the corporation of the Town of
Newcastle enacts as follows:
1'. Schedule 119" to By-law 84-63, as amended, is hereby further amended by
changing the zone designation from "Agricultural (A)" and "Environmental Protection
(E)" zone to "Residential Hamlet Exemption (RH-3)" as indicated on the attached
Schedule "X" hereto.
2. Schedule "X" attached hereto shall form part of this By-law.
3, This By-law shall come into effect on the date of passing hereof, subject
to the provisions of Section 35 of the Planning Act.
