SUBJECT: REZONING APPLICATION - ROCKWOOD DEVELOPMENTS
PART LOTS 28,29,30 & 31, B.F.CONC. & CONC. 1 FORMER TWP. OF CLARKE
DEV 88-50 (X-REF 88-35/D/N & 18T-88027)
RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1. THAT Report PD-161-88 be received; and
2. THAT application to amend the Town of Newcastle Comprehensive Zoning By-law
I
84-63, as amended, submitted by Rockwood Development, be referred back to
Staff for further processing and the preparation of a subsequent report
upon receipt of all outstanding comments; and
3. THAT a copy of Council's decision be forwarded to the applicant.
1. BACKGROUND
1.1 On May 10, 1988, the Town of Newcastle Planning and Development Department
received an application to amend the Town of Newcastle Comprehensive Zoning
By-law 84-63, as amended. The application submitted by Rockwood
Developments would permit the development of Low, Medium and High density
residential components to a total of 1000 units; a hotel; a marina; and a
community centre.

1.2 Rockwell Developments has made application with the Region of Docbom to
amend the Durham Regional official Plan and the Town of Newcastle Official
Plan, as well as making application for Plan of Subdivision approval.
1.3 Staff would note for the Committee's information that, pursuant to Council's
resolution on July 26, 1982 and the requirements of the Planning AoL' the
appropriate aiguage acknowledging the application was installed on the
subject lands and surrounding property owners were advised of the proposal.
2.0 OFFICIAL PLAN CONFORMITY
3.1 The subject property is presently designated "Residential" amd "Waterfront
Belated Open Space", as well some would appear to be affected by Section
12.3.3 of the Durham Regional official Plan Symbols for "marina",
"recreational node", "tourist activity node" are also located on the subject
property.
2.2 The Town of Newcastle official Plan designates the property "residential"
and "waterfront related major open space". Symbols include "marina",
recreational uodex, "tourist activity node" and "utility". Staff further
note some of the proposed lands would appear to be outside the present
(
urban boundaries.
The Town of Newcastle official PImu has set a target population of I100 for
the subject area (Neighbourhood 3B) . The plan proposes I000 units, which
would equal a proposed population of approximately 3000 persons. A density
calculation is not possible at this point, as total laud area proposed for
the hotel, marina and community centre is out final.
3. COMMENTS
3.1 To date comments remain outstanding from nine (9) of the circulated agencies
Agencies which have responded include Newcastle Fire Department, Newcastle
Hydro Commission, Gaoacaahm Conservation Authority and the Ministry of
Natural Resources.

3.2 Comments that require further investigation on the part of the applicant,
were made by Gauazaoka Conservation Authority and Ministry of Natural
Resources. Both are concerned with the extent of the Environmental
Protection Zone as it relates to proposed development. The Authority has
requested that the minimum setback in establishing the shoreline
Environmental Protection be approximately 35 to 45 m as recommended in the
Brown Report (1979) .
3.3 Other oouoecoo such as the proposed road and Storm water ooIIeotiuu should
also be reviewed with the authority. Staff have further suggested clauses
/ to be incorporated in the Subdivision Agreement.
4. RECOMMENDATION
Based on the information presented above and the number of comments still
outstanding, Staff are not presently in n position to make n final
recommendation on the subject application. Staff recommend that, at such
time as all outstanding comments and necessary studies are received, Staff
will be in a position to write m report making a final recommendation on
said application.
