THAT the application to amend the Enniskillen Hamlet Plan submitted by W.G. Dallas on behalf of Kalee Investments Limited, to develop a second phase to Hilltop Estates (10M-786) be referred back to Staff for a subsequent report pending Staff's receipt of the outstanding comments; and 3. THAT the applicant be so advised. 1. BACKGROUND: 1.1 On April 18, 1988, the Planning Department received an application from W.G. Dallas for Kalee Investments Limited, to amend the Enniskillen Hamlet Plan by extending the northern limits of the Hamlet to include a 12.3 hectare parcel, Part Lot 19, Concession 8 in the former Township of Darlington. . . .2 III ,~ REPORT K0. : PD-I46-88 PAGE 2 ------------------------------------------------------------------------------- 1.3 The amendment would permit the development of approximately 22 to 25 One Acre Lots on private services as a second phase of Hilltop Estates (Plan 100-786) . Staff would note that a site investigation indicated that approximately G beotncea are presently used for agricultural purposes and the remainder is wooded. 2. OFFICIAL PLAN CONFORMITY: 2.1 Enniskillen is identified as o Hamlet for Qcmxtb in the Durham Regional Official Plan. The maximum growth potential for the Hamlet is approximately 200 additional residential units. Section I8.4,1.3 of / the Plan states that development in Hamlets should develop in depth rather than strips. Furthermore, both the Durham Regional Official Plan and the Town of Newcastle Official Plan require the submission of an Engineering Study to ensure the suitability of lands for private services. 3. ZONING BY-LAW CONFORMITY: 3.1 Within the Town of Newcastle Comprehensive Zoning By-law 84-63' as amended, the subject lands are zoned as x&gciooItocal (&)x. The predominant use of lands so zoned shall be for agricultural and farm-related uses. Staff would note that the zoning would have to reflect the change in land use accordingly. 4. PUBLIC NOTICE: 4.1 Staff would note for the Committee's information that, pursuant to Council's resolution of July 26, 1982 and the requirements of the Planning Act, the appropriate aiguage acknowledging the application was installed on the subject lands. ` ^ ^ ^3 REPORT 00. : yD-146-88 PAGE 3 _______________________________________________________________________________ 5. CIRCULATION: 5.1 In accordance with departmental procedures, the subject application was circulated to various agencies and departments to obtain comments. The following departments/agencies offered no objection to the proposal: - Town of Newcastle Building Department - Ministry of Natural Resources 5.2 Town of Newcastle Public Works tmeot "We have reviewed the above-noted application and have no objections in principle subject to the following comments: l. That all works are completed in accordance with the Town of Newcastle's Design Criteria and Standard Drawings. 2. That any easements required by the Town be granted free and clear of any encumbrances. 3. That the appropriate road widening and sight triangles be dedicated to the Town. 4. That the developer will bear the costs (I00%) of any works on old 8cogog Road which are necessitated as a result of this development (ie. intersection improvements etc) . 5. That the utility distribution on the internal streets (Hydro, Bell etc.) be installed underground and that all secondary services for the proposed lots be underground. ' 6. That the developer contributes to the reconstruction of Old 8cogog Road in accordance with Town Policy. 7. That the developer meet all the requirements of the DobIio Works Department, financial or otherwise. O. That the Owner enter into o Development Agreement with the Town and that this department be kept informed of the status of same at all times. 9. All of the other standard requirements: Lot Grading, Schedules of Work, Performance Guarantees, Coot Estimates, etc., should be included in the Development." . . .4 N�REPORT D0, : PD_I46_88 PAGE 4 ' _______________________________________________________________________________ 5.3 The Town of Newcastle Fire Department offered no objection to the proposal noting that the development will fall within the area of the proposed uurtberu fire station for fire protection. Water supply for firefighting is by Fire Department tanker trucks. In addition, the Department requested that building construction is to be in aconcdouoe with Ontario Building and Fire Codes. 5.4 The Regional gIauuiug Department offered no objection to the proposal noting that the development conforms to Section I0.4.1.2 of the Durham Regional Official Plan' however, noting that this section requires the approval of the Department of Health Services. In addition' other Regional concerns, financial and otherwise, can be dealt with through / the related plan of subdivision. The Regional Planning Staff also noted that the amendment to any Hamlet Development Plan moot be received by Regional Council prior to adoption by Town Council. 5.5 The Regional Health Services Department offered no objection to the rezoning. However, the number of lots that are suitable for on-site sewage diag000I will be determined when the subdivision proposal is circulated to the department along with other pertinent information. 5.6 The Ministry of Agriculture and Food noted that the site contains CInaa 1-4 agricultural laud and, that the application nmat be 000eaaed in ( terms of the Foodloud Guidelines. The Ministry requires the documentation outlined in Section 3.14 of the Guidelines to do the evaluation. Until Ministry Staff have reviewed the requested information, they will not be in favour of changing the present official Plan designation. 5.7 Staff would note for the Committee's information that comments are still outstanding from the following departments/agencies: - Town of Newcastle Community Services Department - Central Labe Ontario Conservation Authority - Northumberland G Newcastle Board of Education - Peterborough-Victoria-Northumberland & Newcastle Roman Catholic Separate 8obooI Board - Beglnu of Durham Works Department - Ministry of Environment - Ontario Hydro REPORT N0. : gD-146-88 PAGE 5 ~' _______________________________________________________________________________ 6. COMMENTS: 6.1 In consideration of the oonxneota from the Ministry of Agriculture and Food, it is noted for the Committee's information that when an expansion of any urban area is proposed mutn farmland, the use moat be justified as outlined in Section 3.14 of the Foodlaud Guidelines. Accordingly, Section 3.14 requires that the need for the land use for residential purposes must cover each of the fnoc following basic issues: the necessity for the laud use; the anmoot of land needed; the reasons for the choice of location; and the consideration given to alternate locations on lower capability agricultural lands. The relevant provisions of Section 3.14 goes on to further expand the reIvaut criteria to be considered. The Ministry of Agriculture and Food has indicated that upon receipt of this information, a more detailed response would be provided. 6.2 As noted above, the Cmcbam Regional official Plan and the Town of Newcastle Official DIao requires an Engineering Study to be submitted. Staff would note that a Study has not yet been received. 7. CONCLUSION: In consideration of the above-noted comments and the comments still outstanding from various departments/agencies, Staff would respectfully zeoonxneud that the application be referred back to Staff in order to prepare o subsequent report.
