THAT Report PD-151-88 be received; and 2. THAT the amending document to the Town of Newcastle Zoning By-law 84-63, through application DEV 87-62, Wayne Bolahood, be received and forwarded to Council for approval; and 3. THAT the Region of Durham be so advised; and 4. THAT the applicant and the applicant's agents be so advised. i 1. BACKGROUND: 1.1 On February 15, 1988 Committee had before them Report PD-46-88 approved Amendment No. 26 to the Town of Newcastle Official Plan (Courtice Major Urban Area) and Amendment No. 5 to the Courtice West Neighbourhood Development Plan permitting the development of four (4) condominium apartment buildings and associated commercial uses on the subject property. Subsequently, through Resolution #C-151-88, Council endorsed the recommendation. . . .2 REPORT K0. : DD-151-88 PAGE 2 _______________________________________________________________________________ 1.2 On June 7, 1988, the 9omz of Newcastle Clerk's Department received notification from the Regional Clerk's Department that, on June I, 1988, Regional Council adopted Amendment 0o. 205 to the Durham Regional Official Plan and Amendment No. 26 to the Town of Newcastle Official Plan. The subject amendments are currently under review by the Ministry. 1.3 Staff would note that recommendations in PD-46-88 noted that the necessary by-law would be forwarded to Committee at such time as the Region of Durham has approved the subject Official Plan Amendment. 2. COMMENTS: 2.1 The Regional Dlmuuiug Report noted a number of issues that must be dealt with through a Site Plan Agreement, such as the exact servicing and aoneao requirements, the exact number of ouita' and lot development � charges. In addition, the applicant moot meet the requirements of the Town financial and otherwise. 2.3 Based on a preliminary site plan submitted, Staff have prepared a by-law for the entire site creating a High Density residential category ( with a Holding symbol '`(8)" with appropriate zone provisions. Prior to the i000muoe of a building permit for each phase of the development, a by-law must be passed to remove the Holding symbol in accordance with Section 16.6.4 of the Durham Regional official Plan which requires the applicant to enter into a Site Plan Agreement with the Town. In doing this, the Town is guaranteed that the conditions of development, financial and otherwise, will be met at every phase of development. 3. RECOMMENDATIONS: Given the above information, Staff would respectfully recommend that ff` . O8EU0W&, Ontario LIK lAl DN: 15.4.7 THE CORPORATION OF THE TOWN OF NEWCASTLE BY-LAW NUMBER 88- being a By-law to amend By-law 84-63, the Comprehensive Zoning By-law of the Corporation of the Town of Newcastle. WHEREAS the Council of the Corporation of the Town of Newcastle deems it advisable to amend By-law 84-63, as amended, of the Corporation of the Town of Newcastle. NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the Town of Newcastle enacts as follows: 1. Section 15.1 "Special Exception Urban Residential Type Four (R4)" Zone is hereby amended by adding thereto, the following new "Special Exception 15.4.7" as follows: 1115.4.7 URBAN RESIDENTIAL EXCEPTION (R4-7) ZONE Notwithstanding Section 15.1 and 15.2, those lands zoned (H)R4-7 on the Schedules to this By-law shall be developed in four (4) separate apartment buildings. The entire site shall be subject to the following zone regulations: a) commercial uses as defined in Section 16.1 shall be restricted to the ground floor of one of the four (4) buildings having a total floor area of (maximum) tM square metres b) maximum number of dwelling units for the entire site shall not exceed 333 units provided no single apartment building shall exceed 95 units c) Building Separate (minimum) above grade 15 metres I d) Setback from public road (minimum) 15 metres e) Setback from abutting properties 10 metres f) Lot coverage shall be 20% for the entire site provided no single building shall exceed 35% coverage g) Landscaped open Space (minimum) 40 Per cent h) Building Height (maximum) 12 stories plus mechanical penthouse i) Parking shall be in accordance with Section 3.14 of this By-law 2. Schedule "X" attached hereto shall form part of this By-law. 1 _ 2 _ 3. This By-law shall come into effect on the date of passing hereof, subject to the provisions of Section 34 of the Planning Act.
