MEETING: General Purpose and Administration Committee DATE: July 18, 1988 REPORT #: pp_15,_gg FILE #: DEV 88-71, LD 320/88 to LD 322/88 (inclusive) SUBJECT: REMOVAL OF "HOLDING" SYMBOL TO IMPLEMENT LAND DIVISION COMMITTEE APPLICATIONS LD 320/88 TO LD 322/88 PART LOT 33, CONCESSION 2, FORMER TOWNSHIP OF DARLINGTON APPLICANT: HAWRYSZKO FILE #: DEV 88-71, LD 320/88 TO 322/88 INCLUSIVE it RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD-155-88 be received; and 2. That the Rezoning Application submitted by Mr. Anthony Laskowsky on behalf of Mr. & Mrs. Hawryszko requesting the removal of the "Holding (H)" symbol from the subject lands within Part of Lot 33, Concession 2, Darlington be approved and the By-law attached hereto be forwarded to Council for i approval; and i 3. THAT the applicant be so advised. 1. BACKGROUND 1.1 On July 6, 1988, the Planning Department received an application submitted by Mr. Anthony Laskowsky, Solicitor, on behalf of Mr. & Mrs. Hawryszko, requesting the removal of the " (H) Holding" symbol from lands in Part of Lot 33, Concession 2, former Township of Darlington. Staff would note that the subject lands through the submission of the Land Division Committee applications, and the conditions attached to the approvals will ensure that the requirements of the Town are met prior to the lots being approved. COMMENTS 3.1 The subject property is presently zoned "Holding-Urban Residential Type One (B)Bl)". The "Holding" symbol can be removed oBou Council being satisfied that the uses to be permitted will be adequately serviced, have adequate access, and will be used for the purposes intended by the by-law. 2.3 This DaccaI was created by consent and as a condition of this approval, the requirements of the Town of Newcastle has to be fulfilled including conformity to the Onuiug By-law. Hence, the removal of the "Holding" symbol is necessary to implement the condition of approval as imposed by the Durham � Region Land Division Committee. � 3.3 Notwithstanding the removal of the "Holding" symbol, at this time the applicant is still required to satisfy the Town's requirements, financial and otherwise, prior to the Town issuing a Letter of Clearance to finalize the necessary deed documents. 2.4 In consideration of the above comments, Staff would have no objections to the removal of the "Holding" aulmdzol as shown on the attached by-law and schedule. ( 2.5 Staff would note for the Committee's information that DOcaoaut to Section 35 of the Planning Act, a by-law amendment to remove the (B) Holding symbol is not subject to the normal appeal period afforded to o standard Rezoning Application and accordingly, is deemed final and binding as of Council's approval of same. WHEREAS the Council of the Corporation of the Town of Newcastle deems it advisable to amend By-law 84-63, as amended, of the Corporation of the Town of Newcastle. NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the Town of Newcastle enacts as follows: 1. Schedule 114" to By-law 84-63, as amended, is hereby further amended by changing the zone designation from "Holding - Urban Residential Type One ((H)R1)" to "Urban Residential Type One (R1)" as shown on the attached Schedule "X" hereto. 2. Schedule "X" attached hereto shall form part of this By-law. 3. This By-law shall come into effect on the date of passing hereof, subject to the provisions of Section 34 of the Planning Act.
