I SUBJECT: REZONING AND SITE PLAN APPLICATION - ARNOLD KERRY PART LOT 34, CONCESSION 6, FORMER TOWNSHIP OF CLARKE OUR FILE: DEV 88-52 I RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD-157-88 be received; and 2. THAT the rezoning/site plan application submitted by Mr. Douglas Coggan on behalf of Arnold Kerry, to rezone a parcel of land to permit a farm implement dealership be referred back to Staff for a subsequent report pending Staff's receipt of the outstanding comments from the departments/agencies. 3. THAT the applicant and the applicant's agent be so advised. i 1. BACKGROUND 1.1 On May 23, 1988 the Planning Department received an application for rezoning and site plan submitted by Mr. Douglas Coggan, O.L.S., on behalf of Mr. Arnold Kerry. The subject application would seek to develop a one (1) hectare (2.49 acre) parcel of land to permit a farm implements dealership in Part Lot 34, Concession 6, in Clarke. . . .2 I i ~�o \ \�} \y~ REPORT K0. : PD-I57-88 PAGE 2 _______________________________________________________________________________ 2. OFFICIAL PIJQV CONFORMITY 2.1 The subject lands are designated as nMo 'oc open Space" in the Durham Regional official Plan. Section 12.3.12 would permit a farm implement dealership within designation provided the use is compatible with the surrounding uses and provided that it is not located on highly productive agricultural lands. In addition the lands must be zoned accordingly within the local municipalities zoning By-law. 3. ZONING BY-LAW CONFORMITY 3.1 The subject lands are currently zoned as '&griooltocml" in the Town of Newcastle Zoning By-law 84-63, as amended. The proposed use would be recognized through an amendment to this by-law. 4. PUBLIC NOTICE 4.1 Staff would note for the Committee's information that, pursuant to Council's resolution of July 26, 1982 and the requirements of the Planning Act, the appropriate oiguage acknowledging the application was installed on the / subject lands. 5. CIRCULATION 5.1 In accordance with departmental procedures, the subject applications were circulated to obtain comments from other departments and agencies. The following departments/agencies offered no objections to the proposal: - Town of Newcastle Fire Department 5.2 The Region of Docbnm Health Services Department offered no objection to the rezoning, however requested the submission of a drawing indicating the entire yard area to be asphalted and the tile bed area must be grassed. REPORT NO. : PD-157-88 PAGE 3 ------------------------------------------------------------------------------- 5.3 Staff would note that comments have not been received from the following agencies/departments: - Town of Newcastle Public Works Department - Regional Planning Department - Regional Works Department - Ministry of Agriculture and Food - Ministry of Environment 6. COMMENTS 6.1 The proposal would develop one (1) hectare of a larger 66.46 hectares (164.23 acres) parcel of land presently zoned "Agricultural (A) " and "Agricultural Exception (A-1)". The proposed building to be constructed would be approximately 557.47 square metres (6000 square feet) . The uses proposed would permit the sales and services of farm implement machinery as well as the storage of parts. Staff would note that the site plan does not indicate the number of spaces to be provided for the machinery. In addition, no indication as to signage and the placement of private servicing is indicated on the site plan. 6.2 Given the above, Staff would respectfully recommend that the application be referred back to ,Staff for a subsequent report pending Staff's receipt of the outstanding comments. In addition, the applicant's agent may prepare more detailed information required for the execution of a site plan agreement.
