SUBJECT:
REMOVAL OF "HOLDING" SYMBOL TO IMPLEMENT PLAN OF SUBDIVISION
PART OF LOT 13, CONCESSION 1, FORMER TOWN OF BOWMANVILLE
APPLICANT: WAVERLY HEIGHTS SUBDIVISION (OSHAWA) LIMITED

RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:

1. THAT Report PD-160-88 be received; and

2. THAT the By-law amendment attached hereto to remove the (H) Holding Symbol
from said lands within Part of Lot 13, Concession 1, former Town of
Bowmanville, be approved.

1. BACKGROUND
On June 29, 1988 the Planning Department received an application submitted
by Waverly Heights Subdivision (Oshawa) Limited requesting the removal of
the " (H) Holding" symbol from lands in Part of Lot 13, Concession 1, former
Town of Bowmanville. Staff would note the subject lands through Plan of
Subdivision 18T-85035 has received the appropriate draft plan approval, and
subsequently thereto the completion of a subdivision agreement between the
Owner and the Town. j

1.2 The "Holding" symbol shall be removed upon Council being satisfied that the
uses to be permitted will be adequately serviced, the lands to be used have
adequate access, prior uses of the land will not prevent the use of the land
for the purposes intended by the By-law, that the lands and proposed uses
will be adequately protected from any physical or manmade hazards and
conditions associated with the lands, and that the agreements in respect of
such matters and the associated financial requirements, where required, have
been executed with the Town of Newcastle and/or the Regional Municipality of
Durham.
1.3 Staff are now in a position to recommend that the "(H) Holding" symbol be
lifted, inasmuch as the conditions of draft approval requested as conditions
of the Town's approval, have been fulfilled through the Development
Agreement.
1.4 Staff have no objection to the application and would respectfully recommend
that the attached by-law be forwarded to Council for approval.

BY-LAW NUMBER 88-
being a By-law to amend By-law 84-63, the Comprehensive zoning By-law of the
Corporation of the Town of Newcastle.
WHEREAS the Council of the Corporation of the Town of Newcastle deems it advisable
to amend By-law 84-63, as amended, of the Corporation of the Town of Newcastle.
NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the Town of
Newcastle enacts as follows:
1. Schedule 113" to By-law 84-63, as amended, is hereby further amended by
changing the zone designation from "Holding - Urban Residential Type One ((H)R1)"
to "Urban Residential Type One (R1)" as shown on the attached Schedule "X" hereto.
2. Schedule "X" attached hereto shall form part of this By-law.
3. This By-law shall come into effect on the date of passing hereof, subject
to the provisions of Section 34 of the Planning Act.
