SUBJECT: EXEMPTION FROM PART LOT CONTROL - SUBDIVISION 18T-76027
COURTICE HEIGHTS SOUTH
PART LOTS 31 & 32, CONCESSION 2, DARLINGTON
PLANS: 1OM-805, 1OM-806 & 1OM-807
RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1. THAT Report PD-138-88 be received; and
2. THAT the request submitted by Mr. Bill Manson on behalf of Courtice Heights
Development Ltd. for removal of part lot control on Lots 1 to 31 inclusive,
Plan 1OM-805, Lots 17 to 27, 57 to 62 all inclusive, Plan 1OM-806; and Lots
21 to 62 inclusive, Plan 1OM-807, be approved; and
3. THAT the attached by-law be approved and forwarded to the Regional
Municipality of Durham pursuant to Section 49, Subsection (7) of the
Planning Act; and
4. THAT Courtice Heights South be so advised.
1. BACKGROUND
1.1 Staff received a request from Mr. Bill Manson on behalf of Courtice Heights
Developments Ltd. for removal of Part Lot Control in respect of Lots 1 to

31 inclusive on Plan IOM-805; Lots 17 to 27 inclusive and Imto 57 to 62
inclusive on Plan 10M-806; and Imto 21 to 62 inclusive on DIau IOM-807.
1.2 The purpose for removal of Pact Lot Control is to permit the
construction of semi-detached/link dwelling units on the lots in
question.
2 COMMENTS
2.1 Staff have reviewed the request and have on objection to the approval
/ of the by-law exempting the subject lands from Part Lot Control.
2.2 In that regard, attached herewith is a by-low which requires approval
of Council and the Regional Municipality of DNcbom which would exempt |
the subject lands from Section 49(5) of the Planning Act pursuant to
the provisions of Section 49(7) of said Act.
2.3 Ouoe all the dwellings are erected and conveyed, staff will bring forth
a by-law repealing this by-law so that Pact Lot Control will be
restored on the subject property in accordance with the Planning Act.

THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW NUMBER 88-
being a By-law to designate a certain portion of a registered plan as not being
subject to Part Lot Control.
WHEREAS the Council of the Corporation of the Town of Newcastle deems it
desirable to exempt from Part Lot Control, Lots l to 31 Inclusive of Plan 10M-805,
registered at the Land Registry Office for the Land Registry Division of Newcastle
(No. 10) on April 25, 1988.
AND WHEREAS the Council of the Corporation of the Town of Newcastle deems it
desirable to exempt from Part Lot Control, Lots 17 to 27 Inclusive, 57 to 62
Inclusive of Plan 10M-806 registered at the Land Registry Office for the Land
Registry Division of Newcastle (No. 10) on April 25, 1988.
AND WHEREAS the Council of the Corporation of the Town of Newcastle deems it
desirable to exempt from Part Lot Control, Lots 21 to 62 Inclusive of Plan 10M-807,
registered at the Land Registry Office for the Land Registry Division of Newcastle
(No. 10) on April 25, 1988.
NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the
Town of Newcastle enacts as follows:
1. THAT Subsection (5) of Section 49 of the Planning Act shall not apply to
those lands described in Schedule "A" attached to this By-law.
2. This By-law shall come into effect upon being approved by the Regional
Municipality of Durham and thereafter Subsection (5) of Section 49 shall cease
to apply to the lands described in Schedule "A" attached hereto.
3. Schedule "A" attached hereto shall form part of this By-law.
