RECOMMENDATIONS:
It is respectfully recormmended that the General Purpose and Administration
Committee recommend to Council the following:
1. THAT Report PD-136-88 be received; and
2. THAT the rezoning and site plan application submitted by Mr. Marvin
Christl, to rezone a parcel of land, Part Lot 15, Broken Front Concession,
former_ Township of Darlington, be referred back to Staff for a subsequent
report pending Saff's receipt of all comments from outside agencies;
3. THAT the applicant be so advised.
1. BACKGROUND
1.1 On April 13, 1988, the Planning Department received an application for
rezoning submitted by Mr. Marvin Christl to rezone a 3.6 hectare parcel of
land, located in Part Lot 15, Broken Front Concession, in the former
Township of Darlington. The application would seek to develop two

1.1 buildings as self-storage units, in addition to permitting the
construction of log and timber homes on site. The applicant also wishes to
construct a model log office in the future.
2. CONFORMITY WITH OFFICIAL PLAN
2.1 The subject lands are designated as "Industrial" within the Durham Regional
Official Plan. It would apepear that the proposed use would conform with
the intent of the Official Plan. In addition, Staff would note that the
subject lands lie outside the boundary of the Bowmanville Urban Area.
3. CONFORMITY WITH ZONING BY-LAW

3.1 The subject lands are currently zoned "Holding-Light Industrial ((H)Ml)"
and "Environmental Protection (EP) " by the Town of Newcastle Comprehensive
Zoning By-law 84-63, as amended. Staff would note that two-thirds (2/3) of
the lot are zoned "EP", in consideration of the Darlington Creek Watershed
and the Ontario Hydro easement. Additionally, any development on these
lands would require the "Holding" prefix to be removed, should Council deem
it appropriate. Staff would note, however, that the self-storage units
are a permitted use within the "Ml" zoning, the manufacturing of log homes
is only permitted within the "General Industrial (M2)" zone. Should the
application be approved, the by-law amendment would be site specific to
reflect the variety of uses.
4. PUBLIC NOTICE

4.1 Staff would note for the Committee's information that, pursuant to
Council's resolution of July 26, 1982 and the requirements of the Planning
Act, the appropriate signage acknowledging the application was installed on
the subject lands.

5. AGENCY COMMENTS
5.1 In accordance with departmental procedures, the subject application was
circulated to obtain comments from other departments and agencies. The
following departments/agencies offered no objection to the proposal.
- Town of Newcastle Building Department
- Ministry of Transportation and Communication
The following agencies/departments have yet to comment:
- Town of Newcastle Public Works Department
- Town of Newcastle Fire Department
- Central Lake Ontario Conservation Authority
- Regional Municipality of Durham, Planning Department
- Regional Municipality of Durham, Works Department
- Regional Health Department
- Ontario Hydro
6. COMMENT
6.1 Staff have reviewed the application and would note for the Committee's
information that the parcel was recently subject to a land severance from
the lands to the east. The lands were under the ownership of Mr. Terry
Klawitter and as members of Committee may recall, applications OPA 87-90/D
and DEV 87-100, were made to bring the subject property into the Urban
Services Boundary of Bowmanville in order to faciliate the connection to
municipal water. In that regard, the Klawitter application did not include
the Christl's property.
Given this, it would appear that the present proposal would proceed on
private services.
6.2 The development of these lands would also be under the jurisdiction of the
Central. Lake Ontario Conservation Authority, since it is situated in the
Darlington Creek Watershed, in that regard Staff must await comments from
the Conservation Authority.

7. RECOMMENDATION
7.1 In consideration of the above-noted comments, Staff would respectfully
recommend that the application be referred back to Staff in order to
prepare a subvsequent report upon receipt of the outstanding comments.
