PART LOT 10, CONCESSION 1, FORMER TWP. OF CLARKE OUR FILE: DEV 88-32 WREF: 18T-88017) RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD-135-88 be received; and 2. THAT Rezoning Application DEV 88-32 submitted by Kevin Tunney on behalf of Veltri and Son Ltd. be referred back to Staff for further processing and the preparation of a subsequent report upon receipt of all outstanding comments; and 3. THAT copy of Report PD-135-88 be forwarded to the applicant. 1. BACKGROUND 1.1 On March 30, 1988, the Town of Newcastle Planning and Development Department received an application from Tunney Planning on behalf of Veltri and Son Ltd. to rezone a parcel of land to permit the development of twenty-eight (28) residential lots and a local commercial block. . . .2 REPORT 00. : PD-135-88 PAGE 2 - _______________________________________________________________________________ 1.2 This application was followed up with an application for a proposed plan of subdivision to the Region ebiob requested the Town to provide its recommendation. 2. CONFORMITY TO OFFICIAL PLAN 2.1 The subject property is located in 0eatnuvilIe, n designated hamlet in the Durham Regional Official Plan. 2.2 The NewtouvilIe Hamlet Development Plan designated the subject property Residential. Residential and convenient commercial uses are ' permitted. However, Staff noted that the size of the proposed lots ranges from 0.18 hectares to 0.30 hectares and are not in conformity with the minimum lot size of 0.5 hectare as required. Accordingly, revision to the draft plan is required. 3. PUBLIC NOTICE 3.1 Pursuant to Council's resolution of July 26, 1982 and the requirements of the Planning Ant, the appropriate uigoage acknowledging the application was installed on the subject lands and surrounding property owners were advised of the proposal. 4. COMMENTS 4.1 Staff has undertaken a combined circulation for the rezoning and subdivision applications in order to expedite the process. To date � comments are still outstanding from a majority of the circulated agencies. � the comments received, the �uIIowioq agencies/departments . The following agencies provided some comments or oouoerua with the proposed application: ! i . . .o | � � REPORT 00. : PD-135-88 PAGE 3 _______________________________________________________________________________ 4.3 Town of Newcastle Public Works tmeot Works Staff have completed a preliminary review of the applications and have determined that a Conceptual Site Servicing Report is required. The applicant's Engineer should address the development's servicing needs within this Report. The Public Works Staff recommended the developer's Engineer to discuss the Tacnm of Reference with the Department prior to preparation of this Report. 4.3 Regional Health Department Health Officials noted no objection to the proposals, however, the ' number of lots that are suitable for on-site sewage disposal will be determined when the following information is provided: l. Plans of the proposed subdivision indicating existing and proposed noutoocn at two metre intervals, as well as a surface drainage plan. 3. A soil analysis report indicating that a sufficient number of representative test holes were excavated to a depth of two metres based on final grades. The number of teat holes, preferably test pits, and their locations, is to be determined by representatives of the consultant firm and the Health Department. 3. Subdivision plot plans iudiomtiaug the house, well and septic system locations on each lot. The Report moat indicate groundwater elevations in all test holes after a 24 hour waiting period. Soil samples taken from each test bole at one metre depths are to be analysed for grain size distribution and co-efficient of permeability. A percolation rate for each sample must be estimated in min./cm. 5. CONCLUSION ' 5.1 Staff note that residents in the vicinity of the proposal have taken | interest in the applications, and have some concerns regarding the proposed growth, however, to date' no letters of objection have been received. Staff further note that the Iota as proposed to not comply with either the frontage or lot area required for Residential Hamlet � | (D8) zone. ^ ^ ^4 r REPORT NO. : PD-135-88 PAGE 4 ---------------------------------------------------°--------°------------------ 5.2 Based on the fact that the proposed lot size does not conform to the Hamlet Development Plan and the Zoning By-law, plus the fact that a number of comments still outstanding, Staff are not presently in a position to make a favourable recommendation on the subject applications. 5.3 Staff recommend that the Report be referred back to Staff until all outstanding comments and the above-noted concerns have been addressed. At such time, Staff will be prepared to make a recommendation on the said applications.
