SU&JECT: REMOVAL OF "HOLDING" SYMBOL TO IMPLEMENT LAND DIVISION
APPLICATION LD 131/88 - PT.LT. 35, C. 2, DARLINGTON - SEVERANCE

RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1. THAT Report PD-124-88 be received; and
2. THAT the Rezoning Application submitted by Kingsberry Properties Ltd.
requesting the removal of the "Holding (H)" symbol from the subject lands
within Part of Lot 35, Concession 2, Darlington be approved and the by-law
attached hereto be forwarded to Council for approval; and
3. THAT the applicant be so advised.
1. BACKGROUND:
1.1 On May 5, 1988 the Planning Department received an application submitted by
Kingsberry Properties Limited requesting the removal of the "Holding (H)"
symbol for those lands located within Part of Lot 35, Concession 2, former
Township of Darlington relating to Land Division Committee application LD
131/88.

3. COMMENTS:
2.1 The subject property is DzeoeutIv zoned "Holding-Urban Residential Type
One ((B)8l)n. The "Holding" symbol can be removed upon Council being
satisfied that the uses to be permitted will be adequately serviced,
have adequate access, and will be used for the purposes intended by the
by-law.
2.2 This parcel was created by consent and as a condition of this approval,
'
the requirements of the Town of Newcastle had to be fulfilled including
conformity to the Zoning By-law. Hence, the removal of the "Holding"
symbol is necessary to implement the condition of approval as imposed
by the Durham Region Land Division Committee.
3^3 Notwithstanding the removal of the "HoIdiog« symbol, at this time' the
applicant is still required to satisfy the Tcmoz'a requirements,
financial and otherwise, prior to the Town issuing a Letter of
Clearance to finalize the necessary deed documents.
3.4 In consideration of the above cVovneots, Staff would have no objections
/ to the removal of the "Holding" ovndzol as ahovmz on the attached by-law
and schedule.
3.5 Staff *moId note for the Committee's information that pursuant to
Section 35 of the Planning Act, a by-law amendment to remove the (B)
Holding symbol is not subject to the normal appeal period afforded to a

standard Rezoning Application and accordingly, is deemed final and
binding as of Council's approval of same.

THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW NUMBER 88-
being a By-law to amend By-law 84-63, the Comprehensive Zoning By-law of
the Corporation of the Town of Newcastle.
WHEREAS the Council of the Corporation of the Town of Newcastle deems it
advisable to amend By-law 84-63, as amended, of the Corporation of the Town
of Newcastle.
NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the
Town of Newcastle enacts as follows:
1. Schedule "4" to By-law 84-63, as amended, is hereby further amended
by changing the zone designation from "Holding - Urban Residential Type One
((H)Rl)" to "Urban Residential Type One (Rl)" Zone as shown on the attached
Schedule "X" hereto.
2. Schedule "X" attached hereto shall form part of this By-law.
3. This By-law shall come into effect on the date of passing hereof,
subject to the provisions of Section 35 of the Planning Act.
