SUBJECT: TARIFF OF FEES
PLANNING AND DEVELOPMENT APPLICATIONS
RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1. THAT Report PD-123-88 be received; and
2. THAT the attached by-law amending By-law 83-148 in respect of the Planning
and Development Department Tariff of Fees, be approved.
1. BACKGROUND:
1.1 During the 1987 Budget discussions, Council resolved to have each Department
review and report on the methods of increasing revenue to support various
services in each department other than those obtained through the general
levy. Given the high activity levels of the Planning Department, this
exercise was deferred, pending completion of the year, to provide us with a
broader base for estimating application fees and actual costs related
thereto.
1.2 In addition, at its meeting held on April 7, 1988, Committee of Adjustment
recommended to Council to increase the fee for a Committee of Adjustment

3.1 The following table provides a comparison between the existing fees and

3.2 By-law 83-I48 also authorizes the Town to charge fees for the iaooauoe of
Certificates of Compliance in 0000cdauoe with Property Standards matters.
Increase for this type of fee is not proposed at this time.

3. COMMENTS:
3.1 Within the Planning and Development Department, the available sources
of revenue are the various application fees and the onIe of maps and
publications. With respect to the various application fees, Staff note !
that all fees related to planning matters are presently set by By-law
83-I48 in accordance with the authority granted by the Planning Act,
1983. Building permits have been reviewed previously and adjusted as
pact of the 1987 Budget deliberations. |

< 3.3 The Schedule of Fees contained in By-law 83-I48 has not been updated |
since November, 1983. In order to reflect primarily' the inflationary
increase during these past few years, Staff is recommending to Council |
that a new Fee Schedule be adopted.
3.3 Staff also examined the fee structures in other municipalities and wish
to advise that the DcuDooed fees schedule by the Town is one of the
lowest for urban municipalities in Southern Ontario.

THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW NUMBER 88-
being a By-law to prescribe a tariff of fees for the processing of
applications made in respect of planning matters.
WHEREAS Section 68, Subsection 1 of the Planning Act, 1983, provides that
by-laws may be passed by the Council of a Municipality to prescribe a
tariff of fees for the processing of applications made in respect of
planning matters;
AND WHEREAS such tariff shall be designed to meet only the anticipated cost
to the Municipality or to a Committee of Adjustment constituted by the
Council of the Municipality in respect of the processing of each type of
application provided for in the tariff;
AND WHEREAS By-law 83-148 prescribing a tariff of fees has not been updated
and does not reflect the anticipated cost to the Municipality in respect to
the processing of various applications;
NOW THEREFORE, the Council of the Corporation of the Town of Newcastle,
pursuant to Section 68, Subsection 1 of the Planning Act, 1983, enacts as
follows:
1. The following tariff of fees shall apply for the specified
applications submitted in respect of planning matters:
(a) Rezoning Application -
a) to implement Official Plan Amendment $700.00
and/or Plan of Subdivision
b) all others 300.00
(b) Combined Rezoning and Site Plan Approval
a) to implement Official Plan Amendment 600.00
b) all others 450.00
(c) Site Plan Approval Application
a) agreement required 300.00
b) plans only 100.00
(d) Application for Amendment to Site Plan
or Site Plan Agreement 100.00
(e) Application for Amendment to Hamlet or
Neighbourhood Development Plan 300.00
(f) Clearance Letters in respect of 30.00
Subdivision Agreements

2. The following tariff of fees shall apply to applications submitted
through the Committee of Adjustment for the Town of Newcastle:
(a) Application for Minor Variance $100.00
3. Tariff of fees for the issuance of Certificates of Compliance in
accordance with Property Standards matters:
(a) Residential property, multiple, commercial and industrial
buildings
- one or two units $ 20.00 per unit
- two to five units 15.00 per unit
- six to fifteen units 75.00 plus $5.00 per unit
- sixteen units and over 125.00 plus $1.00 per unit
(b) Free standing industrial and commercial
buildings, single occupancy 25.00 plus $1.00 per 95
square metres of
floor space thereof
(c) Farm Property 25.00
(d) Vacant Property 20.00
4. The tariff of fees herein prescribed for applications in respect of
planning matters shall be the minimum fee prescribed, and any further costs
associated with the processing and/or approval by the Corporation of the
Town of Newcastle of any application in respect of a planning matter shall
also be payable by the applicant. Such costs shall be based upon the
actual costs of processing the appflication including staff time, material
costs and legal expenses, which shall be determined at the time of approval
and made payable as a condition of such approval, or as a condition of
implementing the approval, as the case be.
5. That By-law 83-148 be repealed.
6. This by-law shall come into force and take effect on the date of
passing hereof.
